Abstract
Pravica do odpravnine, ki je določena z Zakonom o delovnih razmerjih, predstavlja pravico delavca, da v določenih primerih prenehanja pogodbe o zaposlitvi prejme denarni znesek, ki delavcu zagotovi minimalno socialno varnost. Ob vsaki spremembi delovne zakonodaje je del pogajanj namenjen tudi ureditvi pravice do odpravnine, saj ta olajša ekonomsko prilagoditev delavca ob izgubi zaposlitve.
Institut odpravnine je v slovenski delovni zakonodaji najbolj celovito urejen v 108. členu ZDR-1, ki ureja pravico do odpravnine zaradi odpovedi pogodbe o zaposlitvi iz poslovnega razloga ali razloga nesposobnosti, osnovo za izračun odpravnine in njeno višino, vštevanje zaposlitve pri pravnih prednikih delodajalca, pravico do odpovedi odpravnine in rok za izplačilo odpravnine. V magistrsko diplomskem delu je predstavljena tudi sodna praksa in teorija, ki sta podali odgovore na dodatna vprašanja o izračunu in višini odpravnine ter o pravici do odpovedi odpravnine, ki jih določbe ZDR-1 ne rešujejo v celoti. Posebna pozornost je namenjena pregledu kolektivnih pogodb na ravni dejavnosti, ki lahko pravico do odpravnine urejajo drugače kot ZDR-1. Nadalje je v magistrsko diplomskem delu obravnavana ureditev odpravnine delavcev, ki jim je bila podana odpoved pogodbe o zaposlitvi v postopku zaradi insolventnosti ali v postopku prisilne likvidacije. Na koncu je predstavljena tudi ureditev pravice do odpravnine za delavce, ki jim preneha pogodba o zaposlitvi za določen čas, ki je bila določena s sprejetjem ZDR-1. Namen zakonodajalca je bil spodbuditi delodajalce, da bi v večji meri sklepali pogodbe o zaposlitvi za nedoločen čas, vendar pa delodajalci z delavci še vedno pretežno sklepajo pogodbe o zaposlitvi za določen čas.

Right to severance pay in case of termination of employment contract for business reasons and termination of fixed-term employment contract |
Secondary abstract: |
The right to severance pay, as defined in Employment Relationship Act, is the right of an employee to receive financial compensation in particular cases of job loss, which provides the employee with minimum social security. Any change in labour legislation requires negotiation of terms of severance right, which facilitates economic adjustment of the employee in the event of loss of employment.
The right to severance pay in Slovenian labour legislation is extensively covered in Article 108 of ERA-1, regulating the severance right in case of termination of employment due to business reasons or incapacity reasons, the basis for calculating severance pay (and its amount), employee´s right to include the period of employment for the employers´ legal predecessors, the right to terminate the severance pay and severance payment terms. Master thesis presents case law and theory, which provide answers to additional questions about calculation and amount of severance pay and the possibility to terminate severance pay. Primary focus is on reviewing specific collective agreements, which may regulate severance rights differently than ERA-1. Furthermore, master thesis discusses severance right regulation in case of termination of employment contract in insolvency proceedings or in compulsory liquidation proceedings. Finally, master thesis details severance right regulation for workers with terminated fixed-term employment contracts, established with the introduction of ERA-1. Legislator intention with this novelty was to encourage employers to employ workers for an indefinite duration. However, fixed-term contracts are still the most common choice with employers. |
