Abstract

Naloga obravnava položaj Republike Slovenije in njenih sodnih organov v očeh Evropskega sodišča za človekove pravice. Skozi nekatere najodmevnejše primere, ki so bili zoper Slovenijo vloženi pred Sodiščem, želi predstaviti pomanjkljivosti sodne prakse v Sloveniji, zaradi katerih so sledile obsodilne sodbe ESČP. Tako s statističnimi metodami kot z metodo kompilacije literature, ki se je s to tematiko poglobljeno ukvarjala, smo preverjali, katere so bile tiste kršitve, ki so jih tožniki Sloveniji najpogosteje očitali, zanimalo nas je tudi, ali je šlo v večini primerov zgolj za eno kršitev ali več, nazadnje pa nas je zanimalo še, ali ima sodna praksa ESČP precedenčni vpliv na odločitve slovenskih sodnih organov. Ker se je ob koncu proučevanja izkazalo, da se število vloženih pritožb na ESČP zoper Republiko Slovenijo skozi leta zmanjšuje, lahko ugotovimo, da gre Slovenija s svojimi izboljšavami v sodnem sistemu v pravo smer, saj se vedno bolj zaveda pomembnosti poznavanja in upoštevanja določil EKČP. Prav tako se sodbe slovenskih sodišč vedno pogosteje navezujejo na sodno prakso ESČP, kar brez dvoma izboljšuje trenutno precej slab položaj Slovenije znotraj Sveta Evrope.

Secondary abstract: In this thesis, we discuss the Republic of Slovenia's position and its judicial bodies in the eyes of the European Court of Human Rights. Through some of the most high- profile cases filed against Slovenia before this court, we wanted to present some of the faults of the case law in Slovenia, which led to the convictions by the ECHR. With both statistical methods and the method of reviewing literature, which dealt in-depth with this topic, we examined which violations the plaintiffs most often accused Slovenia of. We were also interested whether, in most cases, ECHR established only one violation or more. Finally, we were interested if ECHR's case law has established precedents for the decisions of Slovenian judicial bodies. At the end of our research we found that the number of appeals filed with the ECHR against the Republic of Slovenia has been declining over the years, so we could conclude that Slovenia is moving in the right direction with its improvements in the judicial system. Judgments of Slovenian courts are increasingly referring to ECHR's case law, which undoubtedly improves Slovenia's currently relatively poor position within the Council of Europe.
