Abstract

V diplomskem delu je obravnavana in predstavljena sodba Ustavnega sodišča v zadevi %Titova cesta%. Sprva je na konkretnih primerih analiziran komunistični režim kot eden od totalitarnih režimov, v katerem so se množično kršile človekove pravice in temeljne svoboščine, katerih osrednje mesto zavzema človekovo dostojanstvo. Med drugimi je predstavljen tudi vpogled v dogodke, ki jih je doživela pobudnica, katere pravni interes je bil s strani sodišča spoznan in na tej podlagi se je začel postopek. Pregledan je mednarodni pogled na spoštovanje človekovega dostojanstva kot pravno-etičnega temelja. Sledi ugotavljanje nezdružljivosti komunističnega režima z evropskimi standardi na splošno in nato še z demokratično pravno državo preko ustavnosodne presoje Ustavnega sodišča Republike Slovenije. Pregled postopka za oceno ustavnosti in zakonitosti pred Ustavnim sodišče RS v zadevi %Titova cesta% se začne z analizo odloka Mestne občine Ljubljana, s katerim so se nekatere ceste in ulice preimenovale v Titovo cesto. Sledi dejanski pregled postopka in analiza sodbe, ki temelji na obrazložitvi Ustavnega sodišča, s poudarki na simbolnem pomenu Josipa Broza Tita kot vodje komunističnega režima. Pred zaključkom so predstavljena še ločena mnenja ustavnih sodnikov, ki so v predmetni sodbi odločali, s poudarki, ki prikazujejo raznolikost med njimi.

Secondary abstract: The thesis deals with questions in connection with the decision of the Constitutional Court in the %Tito's road% case. Firstly, as one of totalitarian regimes where human rights and freedoms integral to human dignity were violated en masse, the communist regime is analysed with some concrete examples. A view of events that affected the petitioner and formed the basis of her legal interest in front of the Constitutional Court is presented. With this in mind, an international view on the respect of human dignity is presented, as a part of a legal-ethic foundation. Incompatibility of a communist regime with European standards is analysed in general, while its incompatibility with a democratic rule of law is identified through the decisions of the Constitutional Court. The Constitutional review of the %Tito%s road% case begins with an analysis of the municipal ordinance of the city of Ljubljana, by which certain streets and roads were renamed into Tito%s road. This is followed by an overview of the procedures and an analysis of the arguments within the judicial decision, especially the arguments in regards to the legitimate interest and the argument of a symbolic meaning of Josip Broz Tito, as the leader of a communist regime, which were crucial to the decision. Prior to the conclusion, the concurring opinions of constitutional judges, focusing on the differences between them, are provided.
