Abstract

Svoboda gibanja je pravica, ki je zagotovljena z Ustavo Republike Slovenije, v katero je mogoče poseči le pod določenimi pogoji in v skladu z zakonom, osebe v tovrstnih postopkih pa imajo na voljo pravna sredstva, s katerimi se prav tako zagotavljajo ustavne pravice. V magistrskem delu smo se osredotočili predvsem na odvzem prostosti v prekrškovnem postopku, pri čemer smo želeli ugotoviti, ali je odvzem prostosti kot institut primeren glede na težo prekrška kot vrsto kaznivega ravnanja. Pri obravnavi problema smo s pomočjo ustaljenih metod raziskovanja najprej predstavili splošne pojme (kot so človekove pravice in temeljne svoboščine, kazniva ravnanja, ki smo jih razdelili na področje prekrškov in kaznivih dejanj). V nadaljevanju pa se osredotočili na omejitev gibanja s strani državnih organov, s tem pa hkrati na poseg v človekove pravice in sorazmernost uporabe zakonitih ukrepov. Magistrsko delo tako preučuje omejitev gibanja oziroma odvzem prostosti, pri čemer se osredotoči na odvzem prostosti v prekrškovnih postopkih in analizira standard varstva človekovih pravic in temeljnih svoboščin v teh postopkih. Z raziskovanjem smo ugotovili, da je v Republiki Sloveniji že splošno zagotovljen visok standard človekovih pravic na področju omejitve gibanja s strani državnih organov, zato nismo zaznali potrebe po spreminjanju oziroma zaostrovanju zakonodaje.

Secondary abstract: The freedom of movement is a guaranteed right by the Constitution of the Republic of Slovenia which can be intervened only under certain conditions and in accordance with the law. Persons in such proceedings have legal means, which are also provided by constitutional rights. In this master's thesis, focus was primarily put on the deprivation of liberty in infringement procedures, where the aim was to find out whether the deprivation of liberty as an institution was proportional to the gravity of the infringement as a type of criminal offence. Different regular methods of research were used when handling the problem to present first of all the most general concepts (such as human rights and fundamental freedoms as well as criminal offences, that were divided into areas of infringements and penal offences). In the following, it was gradually put focus on the restriction of movement by state authorities, and the intervention in human rights and the proportionality of the use of legal measures. The master's thesis thus studies the restriction of movement or deprivation of liberty where it puts its focus on the deprivation of liberty in infringement procedures and analyses the standard of the protection of human rights and fundamental freedoms in these proceedings. It was found out that the Republic of Slovenia has a guaranteed high standard of human rights in the field of the restriction of movement by state authorities in general, and thus there is no need to change or toughen the legislation.
