Abstract
Diplomsko delo proučuje trenutno zelo aktualno tematiko uporabe policijskih pooblastil v okviru njihovega poseganja v ustavno varovane kategorije človekovih pravic ter varnosti, dolžnosti in pravice tako policistov kot občanov pri izvedbi policijskega postopka.
Delo se osredotoča na policijski postopek v okviru izvedbe splošnega policijskega pooblastila ugotavljanja identitete, posebnosti izvedbe postopka ugotavljanja identitete in identifikacijskega postopka, katerega lahko razumemo kot nadgradnjo oziroma bolj intenziven poseg v človekove pravice pri ugotavljanju identitete. Diplomsko delo policijsko pooblastilo ugotavljanja identitete proučuje z vidika stopnje posega v človekove pravice, tj. v pravico do varstva osebne svobode, prav tako pa pojasnjuje in umešča pojem policijskega postopka, postopka ugotavljanja identitete in identifikacijskega postopka.
Bralca diplomsko delo vodi skozi zakonsko podlago, iz katere izhajajo policijska pooblastila, opredelitev le-teh in njihova delitev na varnostna in procesna pooblastila. V nadaljevanju opredeli pojem in namen, razloge in pomožne metode postopka ugotavljanja identitete, čemur sledi vsebinski sklop z opredelitvijo identifikacijskega postopka, njegova delitev na običajen, občutljiv in nevaren tip postopka ter posebnosti in oblike le-tega.
Navedeno materijo avtorica z uporabo deskriptivnih in retrospektivnih metod prouči in problematizira tako, da poda jasno umestitev osnovnega in enega najpogosteje uporabljenih policijskih pooblastil in postopkov v kontekst človekovih pravic, pri tem pa svoj cilj in edinstven doprinos izkaže v zaključku, kjer ugotovitve tudi uspešno poveže s postavljenimi hipotezami ter tako poda vpogled v kompleksnost prepletanja pravic in pooblastil policije v primerjavi s poseganjem v človekove pravice občanov.

This paper examines a currently very relevant topic, the use of police powers to interfere with certain categories of constitutionally protected human rights, as well as the safety, duties and rights of police officers and citizens during the implementation of a police procedure.
The paper mainly focuses on the police procedure, in which general police powers are used to make an identification. It also describes the characteristics of identification itself and the identification procedure, which can be understood as a greater interference with human rights during identification.
In its core, the paper examines the use of police powers for identification from the perspective of level of interference with human rights, i. e. the right to protection of personal freedom. It also explains the terms police procedure, identification and identification procedure.
The reader of the paper will first learn about the legal basis, determining police powers, the definition of police powers and their division into safety and process police powers. The paper then defines the term identification, its purpose, causes and auxiliary methods. It goes on to define the identification procedure, its division into common, sensitive and dangerous types of the procedure as well as its characteristics and forms.
Using descriptive and retrospective methods, the author examines and addresses these issues by putting the basic and one of the most commonly used police powers and procedures in the context of human rights, while presenting her goal and significant contribution to this field in the conclusion, where she successfully associates the findings with the set hypotheses. In doing so, the author provides an insight into the complex intertwinement of police rights and powers in relation to the interference with the human rights of citizens. |
