Abstract

Vedno bolj se zmanjšuje zaupanje državljanov v avtoriteto in vladne preiskovalne organe tako doma kot v tujini, hkrati pa se povečuje potreba po varnosti. Posledično se vse pogosteje posega po detektivih, za katere so prepričani, da so bolj kritični in nepristranski. Detektivi s svojim delom razbremenijo prenatrpanost dela policistov in sodišč ter so dobrodošla in cenjena dodatna pomoč, kljub temu da še ni zakonodaje, ki bi urejala medsebojno sodelovanje. Diplomsko delo se osredotoča na preučitvi in medsebojni primerjavi vloge detektivov v (pred)kazenskem postopku v Republiki Sloveniji in Združenem kraljestvu Velike Britanije in Severne Irske. Diplomsko delo je narejeno z namenom, da se ugotovi, ali je v obeh primerjanih državah prepoved preiskovanja kaznivih dejanj, ki se preganjajo po uradni dolžnosti, in ali detektivi pričajo na sodišču in posredujejo zaupne podatke ter, če velja nezdružljivost poklica detektiva in odvetnika. Poleg tega ponazori ključno vlogo detektiva v (pred)kazenskem postopku, kjer je sodelovanje z odvetniki predstavljeno v smislu preučevanja in podkrepitve primera, medtem ko do sodelovanja s policijo pride le občasno, in sicer pri predaji primera. Na koncu je bil opravljen intervju z detektivko o detektivski dejavnosti in o njihovem delu ter medsebojnih odnosih med policijo in odvetniki. Ugotovili smo, da detektivi v primerjanima državama ne smejo preiskovati kaznivih dejanj, ki se preganjajo po uradni dolžnosti. Na sodišču veljajo za izurjene priče ter so se na poziv primorani odzvati in predati zaupne podatke, medtem ko nezdružljivost poklica velja samo v Sloveniji, nasprotno pa te prepovedi v Združenem kraljestvu nimajo.

Secondary title: The role of private investigators in (pre)criminal proceedings in the Republic of Slovenia and the United Kingdom of Great Britain and Northern Ireland
Secondary abstract: Trust of citizens in authority and government investigatory bodies is reducing increasingly more both at home and abroad, at the same time need of safety is increasing. As a result, private investigators who are believed to be more critical and impartial are increasingly being approached. With their work private investigators relieve the overcrowding the police officers and courts and are a welcome and appreciated additional help, despite the fact that there is no legislation yet that would regulate mutual cooperation. The diploma focuses on the study and comparison of the role of private investigators in (pre)criminal proceedings in the Republic of Slovenia and the United Kingdom of Great Britain and Northern Ireland. The purpose of the diploma is to determine whether there is a ban on investigating crimes in both countries compared, and whether private investigators testify in court and provide confidential information, and if the profession of detective and lawyer is incompatible. In addition, it illustrates the key role of a private investigator in (pre)criminal proceedings, where cooperation with lawyers is presented in terms of examining and supporting the case, while cooperation with police occurs only occasionally, in the case handover. Finally, an interview was conducted with the detective about activity and their work and the relationship between the police and lawyers. We found that private investigators in the compared countries are not allowed to investigate crimes prosecuted ex officio. They are considered trained witnesses in court and are forced to respond to the summons and hand over confidential information, while the incompatibility of the profession applies only in Slovenia, while in the United Kingdom these prohibitions do not apply.
