Abstract

Sodelovanje Policije in Slovenske vojske na področju nadzorovanja ilegalnih migracij in nadzorovanja južne državne meje poteka od leta 2015 naprej. V letu 2015 med begunskim valom je bilo to sodelovanje omejeno predvsem na področja zbirnih centrov, kjer so pripadniki Slovenske vojske s svojo navzočnostjo poskušali vplivati na red in mir v takih centrih. V kasnejših letih pa se je to sodelovanje preselilo na območje južne državne meje, kjer pripadniki Slovenske vojske sodelujejo s Policijo v mešanih patruljah ali na samostojnih opazovalnicah. Skozi leta sodelovanja so se pojavili nekateri izzivi s strani Policije kakor tudi Slovenske vojske. Enega izmed največjih izzivov predstavlja to, da so pripadniki Slovenske vojske v taki obliki sodelovanja zelo zakonsko omejeni in imajo zelo omejena pooblastila oz. jih sploh nimajo. To v praksi velikokrat predstavlja težavo, saj so posledično manj učinkoviti pri svojem delu. Skozi analizo sodelovanja pri nas in primerjavo sodelovanja vojske in policije v nekaterih drugih državah smo ponudili rešitev, ki bi lahko to težavo odpravila. Predlagali smo, da bi bilo ob ustrezni zakonski ureditvi bolj smiselno in učinkovito za tovrstne načine sodelovanja med Policijo in Slovensko vojsko uporabljati enote vojaške policije.

Secondary abstract: The cooperation between the Slovenian Police and the Slovenian Armed Forces in the field of controlling illegal migration and controlling the southern state border has been ongoing since 2015. During the refugee wave in 2015, this cooperation was mainly restricted to the area of collection centers, where members of the Slovenian Armed Forces tried to encourage peace and order with their presence. In later years, however, this cooperation moved to the area of the southern state border, where members of the Slovenian Army began to cooperate with the Police in mixed patrols or at independent observatories in preventing illegal migration. Over the years of this cooperation, some challenges have arisen both on the part of the Police and on the part of the Slovenian Armed Forces. One of the biggest recognized challenges is the fact that members of the Slovenian Armed Forces are legally quite restricted in this form of cooperation and have limited powers or they don’t possess them at all. In practice, this is often a problem as they are consequently less efficient in their work. Through the analysis of the cooperation between the army and the police in the Republic of Slovenia and the comparison of such cooperation in some other countries, we looked for a solution that could solve this problem. We note that, with appropriate legislation, it would be most sensible and effective for the Slovenian Armed Forces to use military police units to cooperate with the Police in the wider protection of the state border
