Abstract
Namen magistrske naloge je odkriti ovire pri prepoznavi (potencialnih) žrtev trgovine z ljudmi, in sicer oseb, ki se znajdejo v policijskih postopkih pri prehajanju zunanje schengenske meje, oziroma v okviru izvajanja nalog s področja tujske problematike. Naloga je usmerjena v ugotavljanje, ali imajo policisti, ki izvajajo naloge na omenjenem področju, zadostno znanje, da lahko razlikujejo med pojavoma trgovine z ljudmi in tihotapstva ljudi ter s tem povezanega prepoznavanja (potencialnih) žrtev trgovine z ljudmi, kot tudi ugotavljanje, s katerimi težavami/ovirami se srečujejo policisti pri prepoznavi (potencialnih) žrtev trgovine z ljudmi.
Naloga je sestavljena iz petih poglavij. Po uvodu v prvem poglavju sledi drugo poglavje, v katerem so predstavljeni pogoji prehajanja zunanje schengenske meje in bivanja na območju schengenskih držav ter vzroki preseljevanja. Sledi opredelitev trgovine z ljudmi, vključno s pojavnimi oblikami in vzroki za ta družbeni pojav. V drugem poglavju je tudi opredeljena razlika med trgovino z ljudmi in tihotapstvom ljudi, pravne opredelitve trgovine z ljudmi v mednarodnih in nacionalnih dokumentih ter statistični podatki o trgovini z ljudmi v mednarodnem prostoru in na območju Republike Slovenije. V tretjem poglavju so predstavljeni kazalniki prepoznave žrtev trgovine z ljudmi in njihovih storilcev ter dve sodbi Evropskega sodišča za človekove pravice ter sodna praksa s področja trgovine z ljudmi v Republiki Sloveniji. Četrto poglavje obravnava empirični del naloge, v katerem je opredeljen raziskovalni problem, metodologija raziskovanja, zbiranje in analiza podatkov ter interpretacija rezultatov. V petem poglavju pa so predstavljene ugotovitev raziskave. Za odgovor na raziskovalna vprašanja je bilo izvedenih deset intervjujev s policisti, ki izvajajo naloge na področju varovanja schengenske meje in nadzora zakonitosti bivanja tujcev v državi. Opravljeni intervjuji so pokazali, da je v usposobljenosti prepoznave žrtve trgovine z ljudmi največja težava. Policisti so sami izrazili, da imajo premalo znanja s tega področja dela za uspešno prepoznavanje žrtev omenjenega kaznivega dejana. Prav tako je bilo izpostavljeno, da bi morali nadrejeni zaposleni in službe bolj usmerjati policiste k prepoznavanju tega problema.

The purpose of the master thesis is to identify barriers detecting (potential) victims of human trafficking, namely persons who get involved in a police procedure when crossing the external Schengen border or within duties performed in the field of foreigners problems. The thesis is focussed on examining whether police officers performing duties in this field have sufficient knowledge to be able to distinguish between human trafficking and human smuggling and the related detection of (potential) victims of human trafficking; it is also focussed on pointing out the difficulties/obstacles the police officers have identifying (potential) victims of human trafficking.The thesis consists of five chapters. Introduction is outlined in chapter one, followed by chapter two where conditions of crossing the external Schengen border are presented together with stay in the territory of the Schengen states and reasons for migration. Further, the definition of human trafficking including forms and reasons of this social phenomenon. Chapter two also specifies the difference between human trafficking and human smuggling, legal classifications of human trafficking in international and national documents and statistics relating human trafficking at the international level and in the territory of the Republic of Slovenia. Chapter three focusses on the indicators of detection of victims of human trafficking and their perpetrators; two judgements of the European Court of Human Rights and case law of human trafficking in the Republic of Slovenia are also depicted in
chapter three. Chapter four deals with empirical part of the thesis where the research issues, research methodology, collection and analysis of data and an interpretation of results are determined. Chapter five contains findings of the research. Within the research issue, ten interviews with police officers performing duties in the area of Schengen border control and control of legality of foreigners residence were used. These interviews show that qualification for detection of victims of human trafficking is the biggest problem. The police officers themselves are aware of lack of knowledge in this area to be successful at identifying the victims of this criminal offence. It was also pointed out that police officers should be given a better guidance from their superiors and management services for a better recognition of this issue. |
