Abstract
Magistrsko delo obravnava odpoved pogodbe o zaposlitvi iz razloga nesposobnosti javnega uslužbenca. Učinkovito, odzivno in dobro delujočo državno upravo lahko zagotovimo z zaposlitvijo strokovno najbolj usposobljenih in kompetentnih javnih uslužbencev. Samo dovolj izobraženi in strokovno usposobljeni javni uslužbenci bodo sposobni dosegati pričakovane rezultate dela, ki morajo biti ustrezno vnaprej določeni. V magistrskem delu smo raziskali in predstavili mednarodne in nacionalne pravne vire, ki urejajo prenehanje veljavnosti pogodbe o zaposlitvi. Podrobneje smo predstavili načine prenehanja veljavnosti pogodbe o zaposlitvi za delavce in ločeno za javne uslužbence. Poseben poudarek smo posvetili določbam, ki urejajo procesna opravila redne odpovedi pogodbe o zaposlitvi iz razloga nesposobnosti. V empiričnem delu raziskave smo s pomočjo ankete raziskali dejavnike, ki vplivajo na doseganje pričakovanih rezultatov dela in dejavnike, ki ovirajo izvedbo postopkov redne odpovedi pogodbe o zaposlitvi iz razloga nesposobnosti javnega uslužbenca. Magistrsko delo predstavlja prispevek k znanosti in stroki, saj nudi podrobno predstavitev postopka oziroma procesnih opravil, ki zagotavljajo zakonitost redne odpovedi pogodbe o zaposlitvi. V magistrskem delu so predstavljene tudi ugotovitve empirične raziskave, ki pripomorejo k boljšemu poznavanju obravnavane tematike in jih je mogoče uporabiti za nadaljnja raziskovanja.

Master's thesis deals with termination of employment contract due to a public servant incompetence. An efficient, responsive and well-functioning state administration can be ensured through the employment of the most professionally qualified and competent public servants. Only sufficiently educated and professionally qualified civil servants will be able to achieve the expected results of the work, which must be appropriately predetermined. In the master's thesis we reviewed the international and national sources of law that regulate the termination of the employment contract. In details, we presented the methods to terminate an employment contract for workers and separately for civil servants. Particular emphasis was placed on the rules governing the procedural tasks of regular termination of an employment contract due to incompetence. In the empirical part of the research, the survey investigated the factors that influence the achievement of the expected results of work and the factors that hinder the implementation of the procedures of regular termination of the employment contract due to the incompetence of a public servant. The master's thesis contributes to science and the profession, as it provides a detailed presentation of the procedural process that ensure the legality of a regular termination of an employment contract. The master's thesis also presents the findings of empirical research, which contribute to a better understanding of the subject and can be elaborated in further research. |
