Abstract

Prostovoljske organizacije, ki organizirajo letovanja mladoletnih otrok so velikokrat postavljena pred vprašanje pravne odgovornosti za nastalo škodo ali nastanek prepovedane posledice oziroma povzročitve nevarnosti. Na letovanjih mladoletnike spremljajo prostovoljci, ki niso strokovnjaki s področja vzgoje in izobraževanja. Odgovornost prostovoljcev na letovanjih bo primerjana z odgovornostjo strokovnih delavcev v vzgoji in izobraževanju, ki pa veljajo za strokovnjake na svojem delovnem področju. V primeru nastanka škode na letovanjih se postavlja vprašanje odškodninske odgovornosti za nastalo škodo in vprašanje kdo od udeležencev za to škodo odgovarja. Lahko je to organizacija, lahko je prostovoljec, uporabnik prostovoljnega dela, lahko pa tudi njegovi starši oziroma skrbniki. V nekaterih primerih pa je lahko škoda tudi posledica golega naključja. Enako se v primeru škodnega dogodka do katerega pride med šolo v naravi ali strokovno ekskurzijo se prav tako postavlja vprašanje odgovorne osebe, ki za to škodo odgovarja. To je lahko šola, strokovni delavec, učenec ali njegovi starši in skrbniki v primeru posebne odgovornosti. Tudi tukaj lahko gre za naključje. Odškodninska odgovornost strokovnih delavcev in prostovoljcev bo primerjana na podlagi instituta skrbnosti po katerem se presoja skrbno ravnanje posameznikov. V primeru povzročitve nevarnosti ali nastanka prepovedane posledice, ki izpolnjuje elemente kaznivega dejanja se tako v šolskem prostoru kot na letovanjih, prav tako postavlja vprašanje kdo je storilec kaznivega dejanja. Ker predmetno delo obravnava mladoletne osebe, ni nujno da so kot storilci za kaznivo dejanje odgovorni sami, odgovornost je lahko namreč tudi na njihovih odraslih spremljevalcih ali starših.

Secondary abstract: Voluntary organizations that organize holidays for minors are often faced with the question of legal liability for damage or the occurrence of a prohibited consequence or cause of danger. During the holidays, the minors are accompanied by volunteers who are not experts in the field of education. The responsibility of volunteers on holidays will be compared with the responsibility of professionals in education, who are considered experts in their field of work. In the event of damage during holidays, the question of liability for damage is raised and the question of which of the participants is responsible for this damage. It can be an organization, it can be a volunteer, a user of volunteer work, but it can also be his parents or guardians. In some cases, however, the damage can also be the result of mere coincidence. In the same way, in the case of a loss event that occurs during a school in nature or a professional excursion, the responsible person responsible for this damage also arises. This can be the school, the professional, the student, or his parents and guardians in case of special responsibility. Here, too, it may be a coincidence. The liability of professionals and volunteers will be compared based on the institute of diligence, according to which the diligent conduct of individuals is assessed. In the case of causing danger or the occurrence of a prohibited consequence that meets the elements of the crime, both in the school premises and on holidays, the question also arises as to who the perpetrator of the crime is. Since the work in question deals with minors, they do not necessarily have to be responsible for the crime themselves, as their adult companions or parents may also be responsible.
