Abstract

Pravne posledice minimalnih standardov kakovosti v zvezi z zagotavljanjem ustreznega zdravstvenega varstva so tiste posledice, ki nastajajo, in tiste, ki nastajajo, a se v znanosti ne morejo izraziti z gotovostjo, temveč s stopnjo verjetnosti (npr. na področju GSO tako ni mogoče trditi obstoja nekaterih pravnih posledic, saj zaradi kratkotrajne uporabe GSO na trgu, le-te še niso dokazane s stopnjo gotovosti, kljub temu pa so pomembna informacija za ohranjanje zdravja ljudi in okolja). Pravne posledice sem razvrstila glede na njihov vpliv na zdravje ljudi in varstvo okolja, in sicer na pozitivne in negativne pravne posledice ter tudi glede na učinek uporabe GSO (tj. neposredne in posredne pravne posledice). Z namenom opredeliti minimalne standarde kakovosti zdravstvenega varstva v luči uporabe GSO sem v doktorski disertaciji analizirala pravna pravila, ki se med primerjalnopravnimi področji držav članic razlikujejo, predvsem z vidika implementacija pomembnih uredb in direktiv, ki se (ne)posredno nanašajo na področje uporabe GSO. Prav tako sem analizirala tudi pomembne sodbe SEU, ki so povezana z GSO, in sicer z vidika sankcij zoper nepravilnosti oziroma morebitne posledice, ki sledijo po zaključenih sodnih procesih.

Secondary abstract: The legal consequences of the minimum quality standards in relation to the provision of adequate health care are those resulting and emerging, but can not be expressed with certainty in science, but with a degree of probability (for example, in the field of GMOs it can not be claimed that the existence some legal consequences, because of the short-term use of GMOs on the market, they are not yet proven with a degree of certainty, nevertheless important information is to preserve human health and the environment). I will classify the legal consequences in terms of their impact on human health and environmental protection, on positive and negative legal consequences and also on the impact of the use of GMOs (ie direct and indirect legal consequences). In order to define the minimum standards of quality of healthcare in the light of the use of GMOs, I will analyze the legal rules in the doctoral dissertation, which are different from the comparative legal areas of the Member States, especially with regard to the implementation of important regulations and directives that (not) indirectly relate to the scope of the GMO. I will also analyze the important judgments of the EU Court of Justice related to GMOs from the point of view of sanctions against irregularities and possible consequences that follow after the completion of court proceedings.
