Abstract

Uvod in namen: Pacientova pravica do zasebnosti je tematika, ki je v današnjem času aktualna in pomembna, saj kršenje pravice do zasebnosti privede do veliko neželenih posledic, kot sta pacientovo izogibanje zdravljenju in njegova družbena stigmatizacija. Namen naloge je preučiti pravice, ki jih imajo pacienti v sklopu zasebnosti. Metode: Uporabili smo deskriptivno metodo za opisovanje stanja ter metodo analize za preučevanje relevantne literature in zakonodaje za iskanje odgovorov na zastavljeni raziskovalni vprašanji. Rezultati: Ugotovili smo, da so mednarodni pravni temelji oziroma viri za nastanek specifičnih, to je pacientovih pravic predvsem naslednji dokumenti: Splošna deklaracija človekovih pravic, Evropska konvencija o varstvu človekovih pravic, Deklaracija o promociji pacientovih pravic v Evropi in Zakon o varstvu osebnih podatkov. Razprava: V diplomski nalogi smo ugotovili, da so se koncept zasebnosti, njegova obravnava in njegov pomen skozi zgodovino spreminjali, sodobna zakonodaja pa uspešno obravnava zasebnost pacientov. Sklep: V diplomski nalogi smo ugotovili, da obstaja dober zakonodajni okvir pravic pacientov, prikazali pa smo tudi njegov zgodovinski razvoj.

Secondary abstract: Introduction and objective: Patients' right to privacy is a very relevant topic as its breach leads to many side effects, which include aversion to treatment and social stigmatization. The purpose of the diploma thesis is to analyze the rights of patients in regard to privacy. Methods: The descriptive method was used to describe the status and the analysis method to research relevant literature and legislation. Results: It has been determined that the relevant legislation in the context of patients' rights is the Universal Declaration of Human Rights, the European Convention on Human Rights, A Declaration on the Promotion of Patients' Rights in Europe, the Personal Data Protection Act, the Patients' Rights Act, the Medical Profession Act, A Code of Ethical Conduct for Physiotherapists and the Code of Medical Ethics in Slovenia. Discussion: In the diploma thesis I came to the conclusion that the concept of privacy, its discussion and its meaning have changed throughout history and that the modern legislation successfully deals with the privacy of patients. Conclusion: In the diploma thesis I came to the conclusion that a good legislative framework for the privacy of patients is in place and I have also demonstrated its historical development.
