Abstract
Diplomsko delo se ukvarja s pomenom prevladujočega položaja na trgu in možnostmi zlorabe takšnega položaja. Prevladujoč položaj na trgu je položaj družbe, pri katerem ta ni izpostavljena dovolj velikim pritiskom konkurence. Prevladujoč položaj družbe sam po sebi ni protipraven. Zakonodaja želi preprečiti le zlorabo teh položajev. Opredelitev tega, kaj točno šteje za zlorabo položaja, pa je osrednja tematika diplomskega dela. Takšne zlorabe preprečuje člen 102 Pogodbe o delovanju Evropske unije. Analiza omenjenega člena bo predstavljala pomemben del diplomskega dela. Diplomsko delo se v največji meri posveča institutu zlorabe prevladujočega položaja, kot ga pozna pravo Evropske unije. Analiza instituta je bila opravljena s pomočjo deskriptivne, analitične in primerjalne metode ter na podlagi analize sodne prakse organov Evropske unije. Diplomsko delo preučuje področje prava, ki pridobiva na svojem pomenu. Gre za področje, ki ga delno lahko umestimo v sfero javnega, delno pa v sfero zasebnega prava. Zato je iz diplomskega dela razvidna kombinacija delovanja države s kogentnimi pravili in poslovanja gospodarskih družb z večinoma dispozitivnimi pravili. Ker pravo Evropske Unije daje pravno veljavo sodbam sodišč, je del diplomskega dela posvečen tudi analizi pomembnih primerov iz sodne prakse Evropske unije. Obravnavano pravno področje je podvrženo velikim kritikam, tako domačih kot tujih pravnih teoretikov. Zaradi tega ta v zadnjem času doživlja pomembne spremembe, ki sledijo novejšemu razumevanju konkurenčnega prava, na katerega vpliva sodobno razumevanje pravne in ekonomske znanosti. Ugotovitve diplomskega dela podajajo dovolj podatkov za razmislek glede potrebe po spremembah na tem področju v prihodnosti

Secondary abstract: |
The diploma thesis deals with the importance of market dominance and the potential for abuse of such a position. The dominant position in the market is the position of a company, which is not exposed to sufficiently high competitive pressures. The dominant position of a company is not in itself illegal. The legislation seeks only to prevent abuse of these positions. Defining different forms of abuse is a central theme of the thesis. Article 102 of the Treaty on the Functioning of the European Union prevents such abuses. The analysis of the aforementioned article will represent an important part of the thesis. The thesis focuses mostly on the institute of abuse of a dominant position, as known in European Union law. I carried out Descriptive, analytical, comparative method, and analysis of the case law of EU to analyze the institute. The thesis examines the field of law that is gaining in importance. We can partly place this area of law in the sphere of public law and partly in the sphere of private law. Therefore, the diploma thesis shows the combination of the state's operation with cogent rules and the business operations of companies with mostly dispositive rules. As European Union law gives legal effect to the judgments of the Court of Justice, part of the thesis work is also devoted to the analysis of important cases from EU case law. The diploma thesis shows that the field is subject to great criticism from both domestic and foreign legal theorists. As a result, this area has undergone significant changes recently, following a more recent understanding of competition law influenced by such a contemporary understanding of legal and economic science. The findings of the diploma thesis provide the reader with sufficient information on which to form an opinion on the need for change in this field |
