Abstract

Diplomsko delo obravnava problematiko pravice do stavke izvajalcev zdravstvene dejavnosti v javnem sektorju v Republiki Sloveniji (RS). Namen dela je bil proučiti pravico do stavke izvajalcev zdravstvene dejavnosti v javnem sektorju v RS in njene omejitve, ki posegajo v pravico. Zanimala nas je pravna ureditev tega področja v RS in kako je ta učinkovita v praksi. Diplomsko delo je zasnovano iz dveh delov, teoretičnega in analitično-empiričnega. S pomočjo kronološkega pregleda do sedaj izvedenih stavk izvajalcev zdravstvene dejavnosti v javnem sektorju RS in osebne izvedbe intervjujev, v katerih sta sodelovala izbrana intervjuvanca, ki delujeta na tem področju, in sicer generalni sekretar Sindikata delavcev v zdravstveni negi Slovenije in predsednik Sindikata zdravnikov in zobozdravnikov Slovenije, smo v delu prišli do sklepa, ki potrjuje, da so bili delavci v zdravstveni dejavnosti v javnem sektorju kljub zakonskim omejitvam pri izvrševanju svoje pravice do stavke do sedaj učinkoviti. Raziskava je hkrati pokazala, da zakonske omejitve posegajo v pravico do stavke do takšne mere, da delavcem preprečujejo pravico do 100-odstotne stavke. V skladu z Ustavo RS bi moral imeti vsak delavec enake pogoje za izvrševanje pravice do stavke, a se ti v praksi - celo v isti dejavnosti - lahko izredno razlikujejo

Secondary abstract: The diploma thesis deals with the issue of the right to strike of health care providers in the public sector in the Republic of Slovenia. The purpose of the diploma thesis was to examine the right to strike of health care providers in the public sector in the Republic of Slovenia and its restrictions that interfere with the right itself. In the diploma thesis we were interested in the legal regulation of this field in the Republic of Slovenia and how it is effective in practice. The diploma thesis is designed in two parts, theoretical and analytical-empirical. With the help of a chronological overview of the strikes of health care providers in the public sector of the Republic of Slovenia and personal interviews in which selected interviewees working in this field participated, namely the Secretary General of the Trade Union of Nursing Workers of Slovenia and the President of the Trade Union of Doctors and Dentists of Slovenia. We came to a conclusion in the diploma thesis, which confirms that workers in the health sector in the public sector have been effective so far, despite legal restrictions in exercising their right to strike. At the same time, the research showed that legal restrictions interfere with the right to strike to such an extent that they prevent workers from the right to strike 100%. In accordance with the Constitution of the Republic of Slovenia, every worker should have the same conditions for exercising the right to strike, but in practice - even in the same activity - they can be extremely different
