Abstract

Poznavanje slovenske pravne ureditve, ki obravnava problem oploditve z biomedicinsko pomočjo, je bistvenega pomena za ustrezno dojemanje pojma očetovstva in materinstva, pri otrocih, spočetih s tovrstno metodo, in posledično ustrezno pravno urejanje tega področja za zagotovitev in spoštovanje temeljnih človekovih pravic in svoboščin. S pojasnitvijo pojmov in opisovanjem postopkov v povezavi z definicijo starševstva pri otrocih, spočetih s pomočjo biomedicine, in preučevanja pravnih virov, je predstavljena osnovna pravna ureditev področja očetovstva in materinstva pri otrocih, spočetih z biomedicinsko pomočjo za lažjo predstavo o pravicah in dolžnostih posameznika in družbe s tega področja. Z omembo oz. navedbo drugačnih pravnih ureditev oploditve z biomedicinsko pomočjo v nekaterih drugih državah se želi prikazati, da ima Slovenija primerljivo pravno regulativo z evropskimi standardi in da je etično veliko bolje orientirana in naravnana kot na primer ZDA, kjer ni enotne zakonodaje, ki bi urejala to področje. Prav neurejenost ali pomanjkljiva urejenost kažeta, do česa prihaja in kakšne so posledice reproduktivne tehnologije, ob kateri se človeška vrsta spreminja v proizvajalce in potrošnike človeških celic in življenj. Z obravnavo odločitev Evropskega sodišča za človekove pravice glede zadev, ki se nanašajo na področje postopkov oploditve z biomedicinsko pomočjo, se opozarja predvsem na interpretacijo pravice do spoštovanja zasebnega in družinskega življenja

Secondary abstract: Knowledge of Slovenian legal system dealing with the problem of insemination with biomedical assistance is essential for a proper perception of the concept of paternity and maternity in children conceived by this method and consequently appropriate legal regulation in this field to ensure and respect fundamental human rights and freedoms. By explaining the concepts and describing the procedures related to the definition of parenthood in children conceived with the help of biomedicine and studying legal sources, the basic legal regulation of paternity and maternity in children conceived with biomedical assistance is presented to facilitate understanding of the rights and duties of individuals and society in this field. By mentioning or stating different legal regulations for biomedical assisted reproduction in some other countries, one wants to show that Slovenia has comparable legal regulations with European standards and that it is ethically much better oriented than, for example, the USA, where there is no uniform legislation for regulating this field. It is disorder or lack of order that shows what is happening and what are the consequences of reproductive technology, which is transforming the human species into producers and consumers of human cells and lives. By considering the rulings of the European Court of Human Rights on matters relating to biomedical assisted reproduction procedures, attention is paid in particular to the interpretation of the right to respect for private and family life
