Abstract

Različne življenjske izkušnje, načini dojemanja in karakterji ljudi so razlog, da se v času življenja nihče ne more izogniti konfliktom. Sprte stranke imajo na voljo sodno reševanje spora ali pa različne metode alternativnega reševanja sporov. V vsaki družbi se izoblikujejo drugačni izvensodni načini reševanja sporov, prilagojeni trenutnim družbenim razmeram, miselnosti in organiziranosti družbe. 1 Poravnalni sveti v krajevnih skupnostih so bili neke vrste predhodniki mediacije v lokalni skupnosti, saj je ta prevzela njihovo nalogo v današnjem svetu. Kasneje se je razširila mediacija. Pomen in vlogo krajevnih skupnosti so pri nas prevzele občine kot %temeljna lokalna samoupravna skupnost%. Mediacija v lokalni skupnosti omogoča, da lokalno prebivalstvo svoja nesoglasja rešuje na konstruktiven način in ohranja dobre medosebne odnose, kar je bistveno za uspešno (so)delovanje in razvoj lokalne skupnosti. Spodbuja tudi družabnost, saj s tem, ko odpira prostor interakciji in soočenju, omogoča oživljanje komunikacije med posamezniki in skupinami, ki sestavljajo lokalno skupnost.2 Pri obeh obravnavanih oblikah alternativnega reševanja sporov veliko oviro predstavlja slaba obveščenost ljudi o prednostih teh postopkov. S primerjavo in kritično oceno smo uspeli povezati razloge za dolgoročen neuspeh poravnalnih svetov s trenutnimi ovirami pri implementaciji mediacije v lokalno skupnost. Ugotovitve opozarjajo na to, da gre mediacija v lokalni skupnosti v veliki meri po poti, ki so jo tlakovali poravnalni sveti, zato bo potrebno, da bi se izognili ponovnemu neuspehu, za dolgoročen uspeh pri implementaciji in vpeljavi med lokalno prebivalstvo narediti korak naprej v smislu promocije, izobraževanja ljudi in zagotavljanja strokovnosti mediatorjev ter poskrbeti za pravno regulacijo bistvenih elementov

Secondary abstract: Different life experiences, perceptions, and people%s characters are the reason that no individual can avoid conflicts during his or her life. Disputing parties have access to judicial dispute resolution or various methods of alternative dispute resolution. In each society, different out-of-court methods of resolving disputes are formed, adapted to the current social situation, mentality, and organization of the society. Settlement councils in local communities have been a kind of predecessors of community mediation. The role of settlement councils was to mediate in the (amicable) settlement of disputes to maintain and develop good relations between the locals. Later, mediation expanded and the importance and role of local communities in our country were taken over by municipalities as a "fundamental local self-governing community". Mediation in the local community enables the local population to resolve their disagreements constructively and maintain good relations, which is essential for the successful (co)operation and development of the local community. It also encourages sociability by opening up space for interaction and confrontation. It enables the revival of communication between individuals and groups in the local community. In both forms of alternative dispute resolution, a major obstacle was the lack of public awareness of the benefits of these procedures. Through comparison and critical assessment, we were able to link the reasons for the long-term failure of the settlement councils with the current obstacles of the implementation of mediation in the local community. The findings show that mediation in the local community follows the path paved by the settlement councils, which means it will be necessary to take a step forward in terms of promotion to achieve long-term success in its implementation among the local communities, educating people, as well as ensuring the professionalism of mediators, and ensuring sufficient legal regulations
