Abstract

Skozi zgodovino so nerazrešena sporna vprašanja vedno vodila v konflikte. Do sporov in vojn v mednarodnem okolju prihaja še danes, kar negativno vpliva na mednarodno skupnost, zato je ključnega pomena, da se zagotovita varnost in mir, ki sta osnovni človekovi potrebi. Z razvojem mednarodnega prava se je pojavila težnja, naj se spori rešujejo miroljubno, ta težnja je prerasla v dolžnost, kar je vodilo do načela nedopustne uporabe sile ali groženj. V obvarovanju bodočih rodov pred vojnami in zagotavljanju prijateljskih odnosov med državami je bila leta 1945 ustanovljena Ustanovna listina Organizacije združenih narodov, ki v 33. členu določa, naj se spori razrešujejo z uporabo diplomatskih sredstev, med katera sodijo pogajanja, posredovanje, preiskava in sprava, ali pravnih sredstev arbitraže ter Meddržavnega sodišča. Reševanje ali preprečevanje sporov lahko poteka z uporabo posameznega sredstva, možna pa je tudi njihova kombinacija. Da bi obveza reševanja sporov z naštetimi sredstvi živela tudi v praksi, je dolžnost držav, da se sporazumno dogovorijo o tem, katero sredstvo bodo uporabile. Naloga obravnava pogajanja, ki so primarna in najpogosteje uporabljena dejavnost diplomacije, so široko uporabljeno sredstvo in sestavni del vseh drugih načinov reševanja sporov. Predstavljajo pa tudi izhodišče ali celo pogoj za uporabo drugih sredstev mirnega reševanja sporov. Namen naloge je podrobneje predstaviti pogajanja, saj se vlogi in pomenu pogajanj v zunanji politiki majhnih držav, kot je Slovenija, še vedno posveča premalo pozornosti

Secondary abstract: Throughout history, unresolved contentious issues have always led to conflicts. Disputes and wars still accur today, which has a negative impact on the international community. In such an environment, it is cruical that security and peace, which are the fundamental human needs, are ensured. With the development of international law, a tendency to settle disputes peacefully arose, this tendency grew into a duty leading to inadmissible use of force and threats. In order to protect future generations from wars and ensure friendly relations between the countries, the United Nations Charter was established in 1945, which stipulates in Article 33 that disputes should be resolved through diplomatic means, i.e., through negotiations, mediation, inquiry and conciliation, or legal means of arbitration and International Court of Justice. Dispute resolution or prevention, can be done with the use of a single tool, but a combination of them is also possible. My diploma thesis deals with negotiations, which are the primary and the most frequently used activity of diplomacy. Negotiations are widely used tool and are an integral part of all other methods of resolving disputes. Meanwhile, they also represent the starting point or even a condition for the use of other diplomatic and legal means. The purpose of my thesis is to present the negotiations in a more detailed manner. It also focuses on the role and importance of negotiations in the foreign policy of small countries such as Slovenia which deserves more attention in international arena with respect to current scenario
