Abstract
Sodobne demokratične države si v današnjih časih ne znamo predstavljati brez Ustave, ki vsem državljanom in državljankam zagotavlja in nudi človekove pravice in temeljne svoboščine, ter brez institucije, ki te pravice varuje in ukrepa v primeru njihovih kršitev, kar je vsem poznano kot Varuh človekovih pravic in temeljnih svoboščin. Z vsakoletnim izdajanje letnih poročil, Varuh poskuša ozaveščati državljane in organe do kakšnih kršitev prihaja na določenih področjih, ter podati svoja priporočila in predloge, za preprečitev tovrstnih kršitev v prihodnosti. Prav tako poskuša ljudi spodbuditi na seznanitev z lastnimi človekovimi pravicami in temeljnimi svoboščinami, saj je moč opaziti, da se jih ljudje na zavedajo in tako posledično ne zaznajo kdaj so jim bile kršene, prav tako pa so tudi premalo seznanjeni kakšne oblike pravnega varstva lahko izkoristijo v primeru kršitev. Glede na podlagi analize letnih poročil je razvidno, da do kršitev prihaja, zlasti na področju upravnih postopkov, kjer so primarno kršena temeljna načela upravnega postopka ter načela, ki izhajajo iz evropskega kodeksa dobrega ravnanja javnih uslužbencev. V izogib takšnih kršitev v prihodnosti Varuh pri svojem delu izpostavlja delovanje višjih institucij kot so ESČP in ustavno sodišče RS v podobnih primerih, in tako poskuša izpostaviti in opozoriti na resnost kršitev, do katerih s strani organov, ki so zadolženi za pravilno izvajanje postopkov ne bi smelo prihajati.

Analysis of human rights violations in administrative procedures according to the Ombudsman's annual reports for the period 2015-2019 |
Secondary abstract: |
Today, we cannot imagine a modern democratic state without a constitution that guarantees and provides human rights and fundamental freedoms to all citizens, or without an institution that protects these rights and takes action in the event of their violations, which we all know as the ombudsman. By issuing reports on an annual basis, the ombudsman seeks to raise awareness among citizens and authorities of violations in certain areas, and to make recommendations and suggestions to prevent such violations in the future. He/she also tries to encourage people to become aware of their own human rights and fundamental freedoms, as it is clear that people are not aware of them and consequently do not realize that they have been violated; they are also not aware of what forms of legal protection they can use in case of infringements. According to the analysis of the annual reports, it is clear that violations occur, especially in the field of administrative procedures, where the basic principles of administrative procedure and the principles deriving from the European Code of Good Administrative Behavior are violated above all. In order to avoid such violations in the future, the ombudsman emphasizes the work of higher institutions such as the European Court of Human Rights and the Constitutional Court of the Republic of Slovenia in similar cases, and thus tries to highlight and draw attention to the seriousness of the violations, which should not be committed by the authorities in charge of the proper implementation of these procedures. |
