Abstract

Roki v upravnem postopku so v današnjem času pomembna tema, saj jih praktično srečamo vsepovsod in ni posameznika, ki bi se jim lahko izognil. V diplomski nalogi sem se osredotočila predvsem na upravni postopek in pomen rokov, kako so ti roki določeni v pravni ureditvi in koliko kršitev v zvezi s spoštovanjem rokov po poročilih upravne inšpekcije se zgodi vsako leto. Obravnavala sem tudi nadzor nad izvajanjem Zakona o splošnem upravnem postopku. Namen diplomske naloge je bil prikazati analizo pravne ureditve odločanja v razumnih rokih in analizirati letna poročila inšpektorata za javni sektor od leta 2015 do leta 2019. S primeri iz sodne prakse sem hkrati utemeljila še teorijo rokov v upravnem postopku. Pri izdelavi diplomske naloge sem uporabila metodo deskripcije, statistično metodo, analizo primarnih virov in metodo sinteze. Ugotovila sem, da nespoštovanje rokov sodi po poročilih upravne inšpekcije med leti 2015 in 2019 v sam vrh najpogostejših kršitev. Vsako leto je bila prav ta na prvem mestu. Pravna ureditev, ki določa spoštovanje rokov je obravnavana tako v slovenski zakonodaji kot v Evropski konvenciji o človekovih pravic (EKČP), kjer je natančno navedeno, da se postopki vodijo brez nepotrebnega odlašanja. Temu sledi tudi URS, ki zavezuje k odločanju v razumnih rokih poleg sodne tudi izvršilno vejo oblasti.

Secondary title: Time limits in administrative procedure
Secondary abstract: Deadlines in administrative procedure are an important subject nowadays. We encounter them practically everywhere and cannot avoid them. My thesis is focused on administrative procedures and the importance of deadlines. I have focused mainly on how deadlines are set in the legal framework, and how many violations occur every year based on reports of administrative inspection. I have also discussed how implementation of the General Administrative Procedure Act is monitored. The purpose of my thesis was to show the analysis of the legal regulation of decision-making within a reasonable time and to analyse annual reports from Public Sector Inspectorate from 2015 to 2019. I have substantiated the theory of deadlines in administrative procedures with examples from case-law. In the preparation of the diploma thesis I have used the descriptive method, statistical method, analysis of primary sources and synthesis. I found that non-compliance to deadlines is at the very top of most common violations based on the reports of the administrative inspection between 2015 and 2019. The legal regulation determining the observance of deadlines is dealt with in both Slovenian legislation and the European Convention on Human Rights (ECHR), where it is precisely stated that the proceedings are dealt with without undue delay. The latter is also followed by the Constitution of the Republic of Slovenia, which binds the judiciary as well as the executive branch of decision-making power to decide within reasonable time limits.
