Abstract

Danes si poslovanja podjetja brez strojne in programske opreme sploh ne moremo več predstavljati. Podjetja vedno bolj intenzivno investirajo v digitalizacijo poslovanja, saj se zavedajo njenega pomena pri zagotavljanju konkurenčne prednosti. Zaradi ogromnega povpraševanja po inovativni programski opremi, se je na trgu znatno povečalo tudi število programerskih podjetji. Zavedati se moramo, da je programska koda zelo zahtevna za napisati in zelo enostavna za kopiranje. To je tudi razlog, da podjetja vedno več pozornosti namenjajo licenčnim pogodbam, kot učinkovitemu sredstvu pri zaščiti intelektualne lastnine, predvsem avtorskih pravic in patentov. Obstaja več različnih tipov kot tudi modelov licenčnih pogodb, zato je za dajalca licence ključno, da analizira vse možnosti in zavzame pravo strategijo distribucije svojega produkta.

Secondary abstract: Today, we can no longer imagine a company without a machine and software. The company is increasingly investigating the digitalization of business, as they are aware of its importance in providing competitive advantages. Due to the high demand for innovative software, the number of software companies on the market has also increased significantly. We need to be aware that program code is very demanding to write and very easy to copy. This is also the reason why the company is paying more and more attention to licensing agreements as an effective means of protecting intellectual property, especially copyrights and patents. There are several other types as well as models of license agreements, so it is crucial for a license to analyze all the options and take the right distribution strategy for its product.
