Abstract

Moderna ogrozitvena kazniva dejanja so bistveno spremenila klasično pojmovanje kazenskega prava, kar je ključni razlog, da se avtor ne zadovolji z obravnavo področja ogrozitvenih kaznivih dejanj zgolj z vidika posamičnih posebnih kazenskopravnih dobrin (navadno vezanih na tehnološki napredek). Avtor zato v magistrski nalogi razišče področje ogrozitvenih kaznivih dejanj ter pri tem predstavi razvoj pojmov nevarnosti in ogrožanj (še zlasti posebej znotraj koncepta ogrozitvenih kaznivih dejanj) v slovenski kazenskopravni teoriji, ki je za nadaljnji pregled in razvoj ogrozitvenih kaznivih dejanj ključen. Zato v svojem delu preizkusi zasnovani konceptualni sistemski pristop, ki lahko v bodoče omogoči uspešno diferenciacijo pojma nevarnosti znotraj koncepta ogrozitvenih kaznivih dejanj. Odgovoriti želi tudi na problem legitimnosti, ki predstavlja izjemno pomembno vprašanje v povezavi z abstraktnimi ogrozitvenimi kaznivimi dejanji. Po pregledu slovenske evolutivne poti ukvarjanja znotraj izbranih vprašanj nato predstavi tudi primerjalnopravni pogled z vidika nizozemske in common-law teorije in poziva k razpravi.

Secondary abstract: Modern endangerment offences have crucially changed the view on criminal law, which is in turn the deciding factor why author is not satisfied with the approach to the problem only through the special part of criminal law (normally attached to technological progress). This is the reason, why author investigates endangerment offences and genesis of terms danger and endangerment in Slovenian criminal law dogmatics which is crucially important for further theoretical development and overall understanding of this type of offences. Hand in hand with this preoccupation he paves the way towards recognising key differences between different categories concerning danger and endangerment in the concept of endangerment offences. To achieve this goal, he organizes conceptual systematic approach under which the successful differentiation and legitimation (especially important in abstract endangerment offences) is eventually possible in the future. After the presentation of historical evolution of chosen problematics in the field of Slovenian criminal law, he then presents the point of view from Dutch and common-law theory and calls for further debate.
