Abstract
Živimo v živahni in kompleksni globalni skupnosti, kjer inovacije predstavljajo glavno nalogo človeštva skozi zgodovino. Družba v kateri živimo, je vse bolj odvisna od inovacij. Dandanes intelektualna lastnina pridobiva vse večji pomen, zato so nenehna prizadevanja na področju novih odkritij ostala nepogrešljiva za izboljšanje kakovosti življenja in preživetja. Na globaliziranem trgu so patenti pomembna gonilna sila inovacij in rasti.
V magistrski nalogi bomo prikazali patentni sistem na Kitajskem, saj je Kitajska ena izmed največjih gospodarstev na svetu in je pred kratkim postala vodilna sila na področju inovacij. Doživela je izjemno gospodarsko rast, tehnološko napredovala in kar najbolje izkoristila svojo geopolitiko. Inovacije pod vodstvom državne reforme na področju znanosti in tehnologije so vzpostavile makroekonomsko okolje, ugodno za znanost in tehnologijo. Podjetja so se zanimala za vladne pobude in začela veliko vlagati v razvoj, kar je povzročilo povečanje v neposredne tuje naložbe. Kitajska ima popoln pravni sistem za zaščito pravic intelektualne lastnine. Pravo o intelektualni lastnini določa pravne odgovornosti vseh, ki kršijo zakon, vključno s civilno odgovornostjo, kazensko odgovornostjo in izpostavljenostjo upravnim sankcijam. V magistrski nalogi se bomo navezovali na kitajsko podjetje Huawei. V zadnjih letih je bilo slednje izjemno znanstveno usmerjeno v raziskave in razvoj visokotehnološke industrije. Ob ustanovitvi so razvili sistem intelektualne lastnine v podjetju, ki spoštuje znanje, pripisuje pomen znanosti in spodbuja tehnološki napredek. Ta sistem je postavil temelj celotni industrijski verigi tehnološkega razvoja, katerega dosežki so pritegnili pozornost po vsem svetu. V podjetju Huawei spodbujajo pomembne investicije, tako da vsako leto vložijo več kot 10% prihodka v raziskave in razvoj. Huawei je dober primer, ki dokazuje, da se je neprekinjeno vlaganje družbe v inovacije nasploh do zdaj izplačalo. Da bi izboljšali svoj položaj na trgu je podjetje ustanovilo raziskovalni program za inovacije, imenovan (HIRP). Ta program ponuja možnosti financiranja vodilnim univerzam in raziskovalnim inštitutom, ki izvajajo inovativne raziskave.

We live in a vibrant and complex global community where innovation has been a major task of humanity throughout history. The society we live in is increasingly dependant on innovation. Nowadays, intellectual property is gaining more and more importance, so constant efforts in the field of discoveries have remained indispensable for improving the quality of life and survival. In a globalized market, patents are an essential driver of innovation and growth.
In my master's thesis, I will present the patent system in China. Since China is one of the largest economies in the world and has recently become a leading force in the field of innovation, it has experienced tremendous economic growth, technological advancement whilst making the most of its geopolitics. Innovations led by national science and technology reform have created a macroeconomic environment conducive to science and technology. Companies became interested in government initiatives and began to invest heavily in development, increasing foreign direct investment. China has a complete legal system to protect intellectual property rights. Intellectual property law provides for the legal responsibilities of all those who violate the law, including civil liability, criminal liability, and exposure to administrative sanctions. In the master's thesis, I will also refer to the Chinese company Huawei. In recent years, the company has been extremely scientifically focused on the research and development of the high-tech industry. At the time of their establishment, they developed an intellectual property system that respects knowledge, attaches importance to science and promotes technological progress. This system laid the foundation for the entire industrial chain of technological development, the achievements of which have attracted worldwide attention. Huawei encourages significant investment by investing more than 10% of its revenue in research and development each year. Huawei is a good example, proving that the company’s continued investment in innovation, in general, has paid off so far. To improve its market position, the company set up an Innovation Research Program (HIRP) in 2010. This program offers funding opportunities to leading universities and research institutes that conduct innovative research. |
