Abstract
Magistrska naloga obravnava problematiko pravne ureditve varstva živali pred mučenjem v Sloveniji. Najprej so skozi kratek zgodovinski pregled predstavljena stališča ter pravni pogledi na živali, pri čemer je prikazan postopen prehod od antropocentrizma k ekocentrizmu. Namen je opozoriti na položaj živali, ki je mnogokrat slab zaradi človekovega odnosa do njih. V okviru teoretičnega dela je predstavljen pravni status živali »sui generis« kot posebej zaščitenega objekta prava. Sledi podrobna predstavitev obstoječe slovenske zakonodaje s področja zaščite živali, pri čemer so izpostavljene njene pomanjkljivosti, zlasti določbe, ki v obliki »izjem« omogočajo trpljenje živali, predvsem zaradi estetskih ali finančnih razlogov. Izpostavljena je tudi situacija nadzora nad izvajanjem zakonodaje o zaščiti živali, ki predstavlja enega najbolj perečih problemov. Našteti in opisani so organi nadzora v Sloveniji, kjer imajo največji interes za dobrobit živali razna društva za zaščito živali, a žal brez kakršnihkoli zakonskih pooblastil. Predstavljeni so najbolj odmevni primeri mučenja živali pri nas ter epilog katerega so prejeli, med njimi tudi primer za katerega je bila na našem ozemlju izrečena prva zaporna kazen. Na podlagi primerjalnopravne analize pravnih ureditev v državah z visoko stopnjo zaščite živali, se predlagajo najbolj primerne in učinkovite rešitve za izboljšanje slovenske ureditve s področja zaščite živali pred mučenjem. Med evropskimi državami na področju zaščite živali prednjačijo Avstrija, Švica in Švedska, med ameriškimi zveznimi državami pa Maine, Illinois in Oregon, pri čemer so izpostavljene predvsem spremembe, katere so sprejeli v smeri dobrobiti živali in katere bi lahko prenesli tudi v slovenski pravni sistem. Predlaga se podelitev pravic živalim v ustavi, uvedba posebnega organa za nadzor nad izvajanjem določb Zakona o zaščiti živali v obliki t.i. »živalske policije« (ang. animal police). Nazadnje so obravnavane sankcije, kjer se predlagajo višje denarne in zaporne kazni, predvsem pa so predstavljeni razlogi za nujnost uvedbe dveh novih sankcij, ki jih naš pravni sistem v primeru kaznivega dejanja mučenja živali še ne pozna, tj. sankcijo prepovedi imetništva živali ter sankcijo psihološkega svetovanja.

Master's thesis deals with the issue of legal regulation of protection against animal cruelty in Slovenia. First, through a brief historical overview, the viewpoints and legal views on animals are presented, showing the gradual transition from anthropocentrism to ecocentrism. The purpose is to draw attention to the situation of animals, which is often bad because of the human attitude towards them. Within the theoretical part, the legal status of animals »sui generis« as a specially protected object of law is presented. It is followed by a detailed presentation of the existing Slovenian legislation in the field of animal protection, highlighting its shortcomings, especially those provisions that in the form of »exceptions« allow the suffering of animals, mainly for aesthetic or financial reasons. The situation of monitoring the implementation of animal protection legislation is also highlighted, which is one of the most pressing problems. The supervisory bodies in Slovenia are listed and described, where various animal protection societies have the greatest interest in animal welfare, but unfortunately without any legal powers. The most resounding cases of animal abuse in our country and the epilogue they received are presented, including the case for which the first prison sentence was imposed in our territory. Based on a comparative legal analysis of legal regulations in countries with a high level of animal protection, the most appropriate and effective solutions are proposed to improve the Slovenian regulation in the field of protection against animal cruelty. Among European countries, Austria, Switzerland and Sweden are in the lead in the field of animal protection, while leaders among the US states are Maine, Illinois and Oregon. The changes adopted in those countries in the direction of animal welfare and which could be transferred to the Slovenian legal system are highlighted. It is proposed to grant animal rights in the constitution, the establishment of a special body to supervise the implementation of the provisions of the Slovenian Animal Protection Act in the form of »animal police«. Finally, sanctions are discussed, where higher fines and imprisonment are proposed, and above all, the reasons for the need to introduce two new sanctions are presented, which our legal system is not yet aware of in the field of animal cruelty, namely the sanction prohibiting the ownership of animals and the sanction of psychological consultancy. |
