diplomsko delo visokošolskega strokovnega študija
Abstract
Vsak uspešen podjetnik se na določeni stopnji razvoja podjetja sooči s situacijo, ko povečan obseg dela narekuje potrebo po novem delavcu. Pri tem se včasih pojavi dilema ali delavca zaposliti na podlagi pogodbe o zaposlitvi ali z njim skleniti podjemno pogodbo oziroma kakšno drugo pogodbo civilnega prava. Za podjetnika je ugodneje (saj mu ni potrebno plačevati prispevkov in tudi sicer podjemnik ne uživa pravic iz delovnega razmerja), da z novim delavcem sklene podjemno pogodbo, vendar zakonodaja vsebuje omejitve, da podjemnik ne sme biti osebno in nepretrgoma opravljati dela po navodilih in pod nadzorom delodajalca, ker se v tem primeru izkazuje delovno razmerje in ne podjemno razmerje.
V raziskavi, opravljeni med zaposlenimi v gradbeništvu in gostinstvo, sem ugotovila, da jih večina dela na podlagi podjemne pogodbe in ne pogodbe o zaposlitvi. Prav tako pa je tudi zanimiva ugotovitev, da nekateri delajo brez vsakršne pogodbe, kar kaže na kršitev zakonodaje tega področja.

Every successful enterpreneur is, at a certain stage of company development, faced with a situation, when expanding work area demands a new workforce. At this stage a doubt sometimes emerges whether to employ a worker on the basis of employment contract or to conclude a work contract or any other contract under civil law. The enterpreneur benefits more (because he is not obliged to pay any contributions and the contractor does not enjoy any rights from the employment relationship), if he concludes a work contract with the new worker. The legislation, however, does include some restrictions like the one that the contractor must not privately be involved or continously work under instructions and control of the employer, because if so this would then indicate an employment rather than work relationship.
In the research made among the employees in the building sector and gastronomy I have found that most of the employees work on the basis of work contract and not under an employment contract. Further, interesting is also an observation that some employees work without any signed contract at all, which indicates a violation of legislation in this area. |
