Abstract

Očividci imajo pomembno nalogo pri dajanju intervjuja, saj s svojimi izjavami pomembno vplivajo na preiskavo kaznivega dejanja, na njihovo izjavo se lahko opre sodba. Na pričanje vplivajo številni dejavniki, ki vplivajo na verodostojnost in zanesljivost informacij. To so: starost, spol, rasa, vpliv osebne zgodovine, kognitivne sposobnosti, popačenje in priklic informacij, faza zaznave, interpretacija dražljajev, vkodiranje v senzorični spomin, v kratkoročni in dolgoročni spomin ter kasneje priklic in obnova dogajanja. Vsi našteti dejavniki lahko kazenski proces povedejo v napačno smer, namerno (v primeru, da se priče bojijo osumljenca, ne zaupajo kazenskim postopkom zaradi maščevanja do storilca kaznivega dejanja itd.) ali nenamerno (vpliv stresa, ki povzroči drugačno videnje dogajanja, napačno prepoznavanje zaradi slabše pozornosti itd.). Zato je pomembno, da preiskovalci kaznivih dejanj ugotovijo, kako verodostojne in zanesljive so priče, morajo pa se zavedati, da lahko sami s svojo prisotnostjo pričo zavajajo na način pridobivanja informacij. V diplomski nalogi se je ugotavljal vpliv časa od storjenega kaznivega dejanja do pričanja očividca na verodostojnost podanih informacij. Kot je bilo že omenjeno, ima izbira metode zaslišanja pomembno vlogo pri ugotavljanju kaznivih dejanj, zato se je raziskovalo delovanje SAI metode. Žrtve in priče so pogostokrat pod vplivom alkohola in nedovoljenih drog, zato se je analizirala verodostojnost informacij takšnih očividcev ter vpliv starosti le-teh na zanesljivost informacij. Pomembno je tudi, kako deluje človeški spomin in način shranjevanja informacij ter zakaj pride do napak, sprememb ali popačenja informacij v spominu.

Secondary abstract: Eyewitnesses have an important role to play in giving an interview, as their statements have a significant impact on the investigation of a crime, and their statement can be based on a verdict. Testimony is influenced by a number of factors that affect the credibility and reliability of information. These are: age, gender, race, influence of personal history, cognitive abilities, distortion and recall of information, the phase of perception, interpretation of stimuli, encoding in sensory memory, short-term and long-term memory and later recall and recovery. All of the above factors can lead the criminal process in the wrong direction, intentionally (in case witnesses are afraid of the suspect, do not trust the criminal proceedings, revenge against the perpetrator, etc.) or unintentionally (the impact of stress less attention, etc.). It is therefore important for criminal investigators to find out how credible and reliable witnesses are, but they must be aware that they can mislead the witness by their presence in the way they obtain information. In the dissertation the impact of the time between the crime and the eyewitness testimony on the credibility of the provided information, have been investigated. As already mentioned, the choice of interrogation method plays an important role in the detection of crime, so the performance of the SAI method has been investigated. Victims and witnesses are often under the influence of alcohol and illicit drugs, so the credibility of the provided information by such eyewitnesses, and the impact of the age of the eyewitness on the reliability of the information has been analysed. It is also important to understand how human memory works and how information is stored, and why errors, changes or distortions of information in memory occur.
