Abstract
Z razvojem tehnologije postaja spletno nakupovanje blaga in storitev vse bolj priljubljeno med potrošniki. Pri tem je ključno varovanje njihovih pravic, saj takšen način poslovanja ne prinaša samo prednosti, temveč tudi slabosti. Pri pisanju so nam bile v pomoč deskriptivna, statistična, aksiološka metoda, metoda analize, metoda kompilacije in metoda sinteze. Namen magistrskega dela je ugotoviti najpogostejše kršitve, učinkovitost reševanja potrošniških sporov in kako varno je spletno poslovanje za potrošnike. Ugotovili smo, da prihaja do največ kršitev potrošnikov prav s seznanjanjem le teh z njihovimi pravicami, ki jih imajo pred sklenitvijo prodajne pogodbe. Podjetja še vedno zelo pomanjkljivo obveščajo potrošnike o njihovih pravicah. Prav tako smo ugotovili, da potrošniki težko rešujejo spore s prodajalci, saj v Sloveniji ni vzpostavljenega učinkovitega sistema za reševanje potrošniških sporov. Potrošnik ima na voljo več poti reševanja, vendar nobena od njih ni dovolj učinkovita, da bi se spor lahko razrešil. Poleg tega smo prišli prav tako do ugotovitve, da lahko spletno poslovanje v določenih okoliščinah predstavlja nevarnost za potrošnike. Varnost poslovanja je odvisna predvsem od njihove ozaveščenosti in previdnosti pri uporabi spleta. Potrošnik lahko za svojo varnost največ poskrbi kar sam. Ugotovitve magistrskega dela so uporabne tako za potrošnike kot tudi za podjetja. Pomembno je, da so potrošniki seznanjeni s tem kakšne pravice imajo in kam se lahko obrnejo po pomoč v primeru kršenja le teh. Podjetja oziroma prodajalci se lahko seznanijo s trenutno veljavno zakonodajo. Obravnava najpogostejših kršitev pa bo podjetja odvračala od uporabe praks, ki so sporne.

With the development of technology, online shopping for goods and services is becoming increasingly popular among consumers. The protection of their rights is crucial, as this way of doing business brings not only advantages but also disadvantages. The descriptive, statistical, axiological method, the method of analysis, the method of compilation and the method of synthesis helped us in writing this thesis. The purpose of the master's thesis was to determine the most common violations, the effectiveness of resolving consumer disputes and how safe online business is for consumers. We found out that most infringements occur when consumers are not made aware of their rights before concluding a sales contract. Businesses are still very deficient in informing consumers about their rights. We also found out that consumers find it difficult to resolve disputes with sellers, as Slovenia does not have an effective system for resolving consumer disputes. The consumer has several means of resolution, but none of them is effective enough to resolve the dispute. In addition, we have also come to the conclusion that online business can pose a danger to consumers in certain circumstances. The security of their online business depends primarily on their awareness and caution when using the internet. The consumer can take care of his safety on his own. The findings of the master's thesis are useful for both consumers and businesses. It is important that consumers are aware of what rights they have and where they can turn for help in case they are violated. Companies or sellers can also get acquainted with the current legislation. Addressing the most common infringements, however, will discourage companies from using the practices that are contentious. |
