Abstract

Namen zaključnega dela je analizirati sodne primere zoper spolno nadlegovanja na delovnem mestu v Sloveniji. V zaključnem delu so opredeljene različne definicije spolnega nadlegovanja na delovnem mestu, oblike, vzroki, posledice in načini preprečevanja spolnega nadlegovanja. S študijo spolnega nadlegovanja na delovnem mestu v Sloveniji smo ugotovili, da imamo štiri pravne akte, ki urejajo področje spolnega nadlegovanja. Z analizo smo ugotavljali, kdo so najpogostejše žrtve in kdo storilci spolnega nadlegovanja, katera oblika je najpogostejša in v kolikšni meri so odgovorni storilci ter delodajalci in kakšen odnos imajo sodišča do te problematike. Med pomembnejšimi ugotovitvami je ugotovitev, da imamo v Sloveniji zelo malo primerov spolnega nadlegovanja na delovnem mestu, in sicer le 27. Ugotovili smo, da je največ primerov zoper spolno nadlegovanje na delovnem mestu obravnavalo Višje delovno in socialno sodišče; najmanj primerov je obravnavalo Višje sodišče v Kopru in nobenega primera ni obravnavalo Višje sodišče v Celju. Sodišče je ugotovilo, da pri šestih primerih ni šlo za spolno nadlegovanje in pet primerov je vrnilo v ponovno sojenje. Med sodbami je šlo največkrat za tožbo med žrtvijo in delodajalcem, kjer je sodišče v vseh primerih ugotovilo objektivno odgovornost delodajalca in mu prisodilo plačilo odškodnine. Ključna ugotovitev je, da so lahko žrtve soodgovorne za nastalo škodo. Ugotovili smo, da so vse primere prijavile ženske žrtve in da so v vseh primerih bili storilci moški, predvsem tisti v vlogi nadrejene osebe in da je v večini primerov šlo za verbalno spolno nadlegovanje na delovnem mestu. Rezultati analize kažejo, da nimamo podatka o tem, če imajo delodajalci sprejeto politiko preprečevanja spolnega nadlegovanja na delovnem mestu.

Secondary title: Sexual harassment in the workplace- case law in slovenia
Secondary abstract: The purpose of the thesis is to determine case law against sexual harassment in the workplace in Slovenia. The thesis identifies different definitions of sexual harassment in the workplace, forms, causes, consequences, and ways of preventing sexual harassment. By studying sexual harassment in the workplace in Slovenia, we found out that we have four legal acts that regulate the areas of sexual harassment. The analysis determines who is the most frequent victim and who are the perpetrators of sexual harassment, which form is the most common, and to what extent the perpetrators and employers are responsible, and what relation have courts toward this issue. One of the most important findings is that we have very few cases of sexual harassment in the workplace in Slovenia, only 27. We found that most cases against sexual harassment in the workplace were dealt with by Higher Labor and Social court, the least High court in Koper, and no case was dealt with by High court in Celje. The court found that six cases did not involve sexual harassment and remanded five cases for retrial. Among the judgments, the most common was a lawsuit between the victims and the employers where in all cases, the court established the objective responsibility of the employer and awarded him the payment of compensation. The key finding is that victims can be co-responsible for the caused damage. We found that all cases were reported by female victims and that in all cases the perpetrators were men, especially those in the role of a superior, and that in most cases there was verbal sexual harassment in the workplace. The results of the analysis show that we do not have a date if employers have adopted an act about the prevention of sexual harassment in the workplace.
