Abstract

Magistrsko diplomsko delo obravnava pravno ureditev surogatnega oz. nadomestnega materinstva in njegove različne pojavne oblike. Podrobneje analizira dileme, ki so povezane z nadomestnim materinstvom in skuša najti alternative njegovi popolni prepovedi. Pri tem ima podrobnejša analiza nekaterih primerjalnopravnih ureditev ključno vlogo. Dosledna pravna regulacija v tistih državah, ki dovoljujejo nadomestno materinstvo, je zelo pomembna za uspešno zmanjševanje tveganj, ki jih prinaša izvajanje nadomestnega materinstva in hkrati za izkoriščanje njegovih pozitivnih aspektov. Znotraj evropskega prostora igra Evropsko sodišče za človekove pravice ključno vlogo pri čezmejnem izvajanju nadomestnega materinstva in priznavanju starševstva. Slovenska pravna ureditev, ki prepoveduje kakršnokoli obliko nadomestnega materinstva, ni v skladu s potrebami današnje družbe po ustvarjanju lastne družine. Te zaradi opuščanja tradicionalnega pojma »družine« in »starševstva« ter zaradi vse pogostejše neplodnosti žensk zahtevajo pomoč pri spočetju genetskih otrok. Popolna prepoved zaradi izvajanja čezmejnega nadomestnega materinstva ne dosega tistih ciljev, ki jih skuša doseči. Dobro premišljen pravni okvir, ki bi dovolil nadomestno materinstvo, bi pripomogel k zmanjševanju izkoriščanja žensk in kršitev otrokovih pravic ter zmanjšal povpraševanje po čezmejnem nadomestnem materinstvu, po drugi strani pa omogočil uresničevanje pogodbene svobode pri sklepanju pogodb o nadomestnega materinstvu ter nadaljevanje genetskega rodu.

Secondary abstract: This Master's thesis deals with the legal regulation of surrogacy and its various forms. It analyzes in more detail the dilemmas associated with surrogacy and seeks to find alternatives to the complete ban of surrogacy. A more detailed analysis of some comparative law arrangements plays a key role in this. Consistent legal regulation in countries that allow surrogacy is very important for the successful reduction of risks that arise from exercising surrogacy, as well as exploiting its positive aspects. Within the European area, the European Court of Human Rights plays a key role in cross-border surrogacy and the recognition of parenthood. The Slovenian legal regulation which prohibits any form of surrogacy, is not in line with the needs of today's society to create their own family. Due to the abandonment of the traditional concept of "family" and "parenthood" and the increasing rate of infertile women, today's society needs help with conceiving genetic children. Due to cross-border surrogacy, a total ban does not achieve the goals it seeks to achieve. A well thought out legal framework allowing surrogacy would help reduce the exploitation of women and violations of children's rights, reduce the demand for cross-border surrogacy and, on the other hand, enable exercising the contractual freedom of concluding surrogacy contracts and generational continuity.
