Abstract
Jezik in komunikacija sta temeljni sredstvi za človekov razvoj. Prav ti dve komponenti igrata tudi ključno vlogo pri forenzični lingvistiki. Vloga forenzične lingvistike se je skozi njeno zgodovino korenito spreminjala. Na svetovni ravni morajo imeti strokovnjaki z različnih področij, ki se navezujejo na forenzično lingvistiko, velik spekter znanj in komunikacijskih veščin. Tukaj govorimo predvsem o ljudeh, zaposlenih na policiji in v pravosodju. Težave med njimi se velikokrat pojavijo prav pri sodelovanju in interpretaciji dokazov, pridobljenih s pomočjo forenzično lingvističnih analiz. Obravnavana kazniva dejanja puščajo sledi tudi preko zvočnih posnetkov ali besedil. Tukaj v ospredje stopijo forenzični lingvisti, ki vsak primer, vezan na njihovo delo, ustrezno analizirajo. Neenotnost zakonov in dokazna vrednost na sodišču predstavljata izziv za vse sodelujoče. Dejstvo je, da brez enotnosti tako na eni kot tudi na drugi strani obravnavan primer izgublja na svoji vrednosti. Čeprav je znano, da so forenzično lingvistični dokazi redki, pa lahko s pomočjo tehnologije in izkušenosti lingvističnega izvedenca pridemo do koristnih podatkov. Vsaka koristna forenzično lingvistična informacija lahko pri kaznivem dejanju dodatno okrepi ali pa celo dokončno zaključi primer. Pričevanje forenzično lingvističnega strokovnjaka na sodišču je v praksi le redko sprejeto. Glavna ovira, ki se pojavlja v pravnem sistemu, je, da ne pride do sporazuma med odvetniki in forenzičnimi lingvisti, ki podpirajo vsak svojo stran.
V magistrski nalogi je poudarek predvsem na forenzični lingvistiki v tujini in povezanosti s pravnimi sistemi posameznih držav. Vsako kaznivo dejanje, ki se ga preiskuje s pomočjo forenzično lingvističnih tehnik, ima pravico, da je slišano in obravnavano v skladu z zakoni. Posledično sem v svojo magistrsko nalogo zajela tudi znane forenzično lingvistične primere ter jih natančno analizirala in opredelila.

Language and communication are fundamental instruments for human development. These two components play a key role in forensic linguistics. The role of forensic linguistics has changed radically throughout its history. At a global level, experts in various fields related to forensic linguistics need to have a wide range of knowledge and communication skills. Here we are talking mainly about people working in the police and the judiciary. The difficulties between them often arise precisely in the interaction and interpretation of evidence obtained by means of forensic linguistic analysis. The crimes in question also leave traces through sound recordings or texts. This is where forensic linguists come to the fore, analysing each case relevant to their work. The lack of uniformity in the law and the value of evidence in court are a challenge for everyone involved. The fact is that without unity on both sides, the case at hand loses its value. Although forensic linguistic evidence is known to be scarce, the technology and experience of a linguistic expert can provide useful information. Any useful forensic linguistic information can further strengthen or even definitively close a case in a crime. In practice, the testimony of a forensic linguistic expert in court is rarely accepted. The main obstacle that arises in the legal system is that there is no agreement between lawyers and forensic linguists, who each support their own side.
The focus of my Master's thesis is on forensic linguistics abroad and its relationship to the legal systems of individual countries. Any crime investigated using forensic linguistic techniques has the right to be heard and dealt with in accordance with the law. That is why in my master's thesis I also included well-known forensic linguistic examples and analysed and defined them in detail. |
