Abstract

V magistrskem delu obravnavamo postopke oploditve z biomedicinsko pomočjo ter z zakonodajo s tega področja, s poudarkom na pravici samskih žensk do zadevnih postopkov. Uvodoma predstavimo zgodovinski razvoj postopkov oploditve z biomedicinsko pomočjo, tako pri nas kot na splošno. Ravno tako predelamo zgodovinski razvoj zakonodaje s tega področja, oziroma pravic do postopkov oploditve z biomedicinsko pomočjo, tako na mednarodnem področju kot pri nas. V nadaljevanju predstavimo postopke znotrajtelesne in zunajtelesne oploditve in se osredotočimo na postopke primerne za samske ženske. Nato analiziramo aktualno zakonodajo držav članic Evropske unije v povezavi s pravico samskih žensk do postopkov oploditve z biomedicinsko pomočjo in jo v okviru primerjalne metode, primerjamo s slovensko zakonodajo s tega področja. Pri analizi razvoja reproduktivnih tehnologih oziroma samih postopkov oploditve z biomedicinsko pomočjo ugotovimo, da je Slovenija v koraku z ostalimi članicami Evropske unije. Pri analizi zakonodaje oziroma pravice samskih žensk do postopkov oploditve z biomedicinsko pomočjo, pa ugotovimo da v Sloveniji samske ženske navedene pravice nimajo, kar je v nasprotju z večino držav članic Evropske unije. S pomočjo predstavitve sodne prakse predstavimo delček problematike, s katero se, zaradi različnih pravnih ureditev v državah članicah Evropske unije, le te ukvarjajo in jo obravnavajo. Na kratko izpostavimo nekatera moralno-etična vprašanja, s katerimi se danes, predvsem pri nas, spopada reproduktivna medicina.

Secondary abstract: In the master's thesis we discuss the procedures of fertilization with biomedical assistance and legislation in this field, with emphasis on the right of single women to the relevant procedures. At the beginning, we present the historical development of insemination procedures with biomedical assistance, both in Slovenia and in general. We also process the historical development of legislation in this area, or the rights to insemination procedures with biomedical assistance, both internationally and in Slovenia. In the following, we present the procedures of intracorporeal and extracorporeal fertilization and focus on the procedures suitable for single women. We then analyze the current legislation of the Member States of the European Union in connection with the right of single women to procedures of assisted biomedical fertilization and compare it with Slovenian legislation in this field within the framework of the primary method. In the analysis of the development of reproductive technologies or the procedures of insemination with biomedical assistance, we find that Slovenia is in step with other members of the European Union. In the analysis of legislation or the right of single women to procedures of insemination with biomedical assistance, we find that in Slovenia single women do not have these rights, which is contrary to most Member States of the European Union. With the help of the presentation of case law, we present a part of the issue, which, due to the different legal regimes in the Member States of the European Union, they deal with and address. Let us briefly highlight some of the moral and ethical issues that reproductive medicine is facing today, especially in our country.
