Abstract

V diplomskem delu so predstavljene ključne težave, s katerimi so soočeni socialni partnerji v javnem sektorju pri sklepanju kolektivnih pogodb dejavnosti ali višje ravni. Težave se kažejo tako pri pridobivanju statusa reprezentativnosti, s katerim lahko sindikat sklene kolektivno pogodbo, kot pri zakonski določitvi ustreznega kvoruma števila sindikatov, ki je potreben, da se Kolektivna pogodba za javni sektor oz. njeni aneksi štejejo za veljavno sklenjene. Ustavno sodišče je z odločbo št. U-I-249/10 z dne 15. 3. 2012 naložilo zakonodajalcu, da ugotovljeno neskladnost zakona z Ustavo RS odpravi v roku dveh let, kar se še vedno ni zgodilo. Osrednji problem je, da je Republika Slovenija, ki je sicer stranka Kolektivne pogodbe za javni sektor, med pogajanji za sklenitev aneksa k le-tej v vlogi zakonodajalca spremenila »pravila igre« (kvorum), da bi lažje sklenila aneks. Sindikati, ki jih je država (vlada) na ta način želela zaobiti, so zato zahtevali oceno ustavnosti te zakonske spremembe in bili na ustavnem sodišču uspešni. Ustavno sodišče je svojo odločbo obrazložilo tako, da se je zakonodajalec znašel pred težko nalogo, kako zakon spremeniti, da bo skladen z Ustavo RS. Namen tega diplomskega dela je poiskati možno rešitev, npr. da bi zakon predpisal, da je za sklenitev Kolektivne pogodbe za javni sektor oz. aneksa k njej potrebno soglasje vseh sindikatov, vendar bi to praktično onemogočilo sklepanje kolektivne pogodbe oz. aneksov. S tem bi kaj kmalu ponovno prišli v neustavno stanje zaradi kršitve načel prava, saj kolektivne pogodbe ne bi bilo več mogoče spreminjati in prilagajati novim družbenim okoliščinam.

Secondary abstract: The thesis presents key challenges encountered by social partners in the public sector during collective bargaining at the level of individual industries or above. On the one hand, trade unions find it difficult to acquire the representativeness that would allow them to conclude collective agreements; on the other, disputes arise over the legal quorum of trade unions required for a Collective Agreement for the Public Sector and its amendments to be validly concluded. By Decision No. U-I-249/10 dated 15 March 2012, the Constitutional Court of the Republic of Slovenia required the legislator to remedy the incompatibility of the law with the Constitution of RS within two years, which has not yet happened. Main issue is that the Republic of Slovenia, a party to the Collective Agreement for the Public Sector, changed the “rules of the game” (the quorum) during the negotiations on an amendment to the latter in an attempt to facilitate the amendment process. In so doing, the state (i.e., the Government) tried to circumvent the trade unions, who in turn successfully challenged the unconstitutional amendment at the Constitutional Court. However, the Constitutional Court stated in its Decision that the legislator had a difficult task in amending the law in compliance with the Constitution. The thesis aimed to propose possible solutions to this problem, one of them would be to have the law stipulate that a consensus by all trade unions be required for the conclusion of a Collective Agreement for the Public Sector or an amendment to it; however, this would make collective agreements or amendments practically impossible. In turn, this would soon violate the rule of law and lead to an unconstitutional situation, given that collective agreement could no longer be amended and adjusted to changing social circumstances.
