Abstract

Upravno pravo je pravno področje, ki je v moderni oz. sodobni državi nepogrešljivo. Predstavlja standard vsake civilizirane družbe. Njegov namen je usklajevanje javnega in zasebnega interesa, zato ga je vredno obravnavati kot stičišče med interesom družbe in interesom posameznika. Pomemben segment upravnega prava je upravni postopek. Njegova procesna narava nam omogoča, da skozi proces pravil in načel dosežemo ravnotežje med javnim in zasebnim interesom. Hkrati upravni postopek preprečuje arbitrarnost in ščiti pravice strank. Upravni organ je v upravnem postopku zavezan k strogi uporabi načel, na katerih upravni postopek temelji. V upravnem postopku je moč zaslediti pojem diskrecijske pravice. Njena posebnost je, da ne gre za pravico posameznika, temveč za pravico upravnega organa. Na podlagi diskrecijske pravice lahko organ odloča med več zakonsko določenimi možnostmi. Gre za možnosti, ki so pravilne, upravni organ pa izbere tisto, ki je najustreznejša. Pooblastilo za odločanje na podlagi diskrecijske pravice ima organ v samem zakonu oz. podzakonskem aktu. V kolikor mu zakon ali podzakonski akt takšnega pooblastila ne določata izrecno, upravni organ ne sme odločati diskrecijsko. Na podlagi omenjene pravice upravni organ odloča pri izdaji orožne listine posamezniku. Gre za proces, kjer posameznik odda vlogo za pridobitev orožnega lista. Na podlagi predloženih, zakonsko veljavnih dokazov, ki jih mora predložiti posameznik ob oddaji vloge, upravni organ sprejme svojo odločitev.

Secondary abstract: Administrative law is a legal field that is in modern country indispensable. It represents the standard of every civilized society. Its purpose is to reconcile public and private interest. Theory is describing it as a crossroads between the interest of society and the interest of the individual. An important segment of administrative law is administrative procedures. Its procedural nature allows us to strike a balance between public and private interest through a process of rules and principles. At the same time, the administrative procedure prevents arbitrariness and protects the rights of the parties. The concept of discretion can be traced in the administrative procedure. Its special feature is that its not an individual right but an administrative body right. At its discretion, the authority may decide between several statutory options. These are the options that are correct, and the administrative body chooses the one that is most appropriate. The power to decide on the basis of discretion is the name of the body in the law itself or. By-law. Unless the law or an executive act explicitly provides for such an authorization, the administrative body may not decide at its discretion. On the basis of the mentioned right, the administrative body decides when issuing a firearms document to an individual. Its a process where an individual submits an application to obtain a firearms certificate. On the basis of the legally valid evidence submitted, which must be submitted by the individual when submitting the application, the administrative body opposes its determination.
