Abstract

Vprašanja verske svobode, nošenja oz. prepovedi verskih oblačil in islamska radikalizacija postajajo vedno bolj pogosta v evropski in slovenski družbi. Že desetletje vse več evropskih držav sprejema omejitve glede nekaterih verskih oblačil, osredotočajo pa se predvsem na ženska islamska oblačila, kot so burka, hidžab in nikab. Glavni argumenti za prepoved teh oblačil vključujejo enakost spolov, varnost in spoštovanje temeljnih človekovih pravic. Bistvo raziskave v magistrskem delu je analiza zadnje sodbe ESČP glede nošenja verskih oblačil. V sodnem primeru Dakir proti Belgiji je gospa Dakir izpodbijala podzakonski akt, ki so ga sprejele tri belgijske občine. Le-ta je prepovedoval nošenje oblačil, ki zakrivajo obraz na javnih mestih, gospa Dakir pa je trdila, da ji ta določba omejuje pravico do veroizpovedi. Magistrsko delo temelji na pogovoru s strokovnjakom s področja verskih oblačil oz. s poslancem Državnega zbora mag. Brankom Grimsom. S pomočjo raziskovanja smo prišli do ugotovitve, da islamske verske prakse niso skladne z EKČP. Razlog, da lahko znotraj EU prihaja do različnih pravnih standardov, je pozitivno polje proste presoje, ki določa, da imajo nacionalna sodišča prosto presojo nekaterih pravic glede na kulturo in običaje na nekem regionalnem področju. Cilj magistrskega dela je vključevanje rezultatov analiz v vsakodnevno strokovno in laično razpravo. Poglobljena analiza zakonodaje držav Evropske unije na področju verskih oblačil bi lahko predstavljala odlično osnovo za pripravo zakonodaje na tem področju v Sloveniji.

Secondary abstract: Issues pertaining to freedom of religion, the wearing of religious clothing, the ban on religious clothing, as well as Islamic radicalization are becoming increasingly common in both Europe and Slovenia. For a decade now, more and more European countries have been imposing restrictions on certain religious clothing, focusing mainly on women's Islamic clothing, such as the burqa, hijab and niqab. The main arguments for banning such clothing include gender equality, security and general respect for fundamental human rights. The analysis of the last ECtHR judgment regarding the wearing of religious clothing represents the essence of research in the master’s thesis. In Dakir v Belgium Ms. Dakir challenged a by-law adopted by three Belgian municipalities banning the wearing of clothing that concealed the face in public places. She claimed that the provision constituted an interference with her freedom of religion rights. The master's thesis involved conducting an interview with MP Branko Grims, an expert in religious clothing. Through research we've reached a conclusion that Islamic religious practices do not comply with ECHR. The reason that there are different legal standards within the EU lies behind the margin of appreciation, which leaves it to the discretion of national courts to consider culture and traditions in a certain region. The objective of the master's thesis is to include the results of the analysis in everyday professional and amateur discussions. An in-depth analysis of EU legislation on religious clothing could represent an excellent foundation for the preparation of Slovene legislation in this field.
