Abstract

V magistrskem delu bo predstavljena primerjava med Rimskim statutom Mednarodnega kazenskega sodišča ter osnutkom mednarodne konvencije o preprečevanju in kaznovanju zločinov zoper človečnost. Gre za področje mednarodnega kazenskega prava, ki se je razvilo predvsem v zadnjih 100 letih. Med njegove največje uspehe štejemo ravno ustanovitev MKS. To je pristojno za preganjanje štirih glavnih kaznivih dejanj: genocida, vojnih hudodelstev, agresije in zločinov proti človečnosti. Magistrsko delo se bo osredotočalo predvsem na proučevanje zločinov proti človečnosti v Rimskem statutu in osnutku mednarodne konvencije, ki ga je zasnovala KMP. V ta namen bodo uporabljene nekatere znanstvene metode, med njimi deskriptivna metoda, s katero bo podan opis zgodovinskih mejnikov v razvoju mednarodnega kazenskega prava, sintetična metoda, s katero se bo preko več vidikov zločinov zoper človečnost skušala podati enotna razlaga, komparativna metoda, s katero bo izvedena primerjava dveh mednarodnih dokumentov na temo zločinov zoper človečnost, ter kompilacijska metoda, s katero se bo navajalo navedbe in citate drugih avtorjev. Namen magistrskega dela je predstavitev primerjave Rimskega statuta in osnutka mednarodne konvencije. Zločini zoper človečnost so namreč že definirani v Rimskem statutu, osnutek mednarodne konvencije pa na drugi strani predstavlja poskus ustvarjanja univerzalne konvencije na temo zločinov zoper človečnost, ki bi pripomogla k uspešnejšemu preganjanju teh zločinov. Cilj magistrskega dela je zajeti vse podobnosti in razlike med tema dokumentoma, ju pred tem podrobno razdelati in predstaviti mehanizme, s katerimi bodo države lažje preganjale zločine zoper človečnost. Magistrsko delo bo pripomoglo k poglobljenemu razumevanju zločinov zoper človečnost.

Secondary abstract: The master's thesis will show a comparison between the Rome Statute and the Draft articles on Prevention and Punishment of Crimes Against Humanity. International criminal law has developed mainly over the last 100 years. Among its successes is the establishment of the ICC. It is responsible for prosecuting 4 crimes: genocide, war crimes, aggression, and crimes against humanity. The thesis will focus primarily on the examination of crimes against humanity in the Rome Statute and the Draft articles. Certain methods will be used in the thesis, including descriptive method for describing historical milestones in the development of international criminal law, synthetic method for a uniform interpretation through several aspects of crimes against humanity, compilation method for comparing international documents on crimes against humanity, and compilation method for citing references and quotes from other authors. The purpose of the thesis is to present a comparison between the Rome Statute and the Draft articles. Crimes against humanity are already defined in the Rome Statute, and the Draft articles on Prevention and Punishment of Crimes Against Humanity, on the other hand, represent an attempt to create a universal convention on crimes against humanity that would help states to prosecute these crimes successfully. The aim of the thesis is to present all similarities and differences between the two documents, to elaborate them in detail, and to present mechanisms that will make it easier for states to prosecute crimes against humanity. The thesis will help to provide an in-depth understanding of crimes against humanity.
