Abstract
Po obdobju, poznanem po ustanavljanju številnih različnih ad hoc mednarodnih kazenskih sodišč in tribunalov, smo sedaj priča novemu obdobju, v katerem ta sodišča postopoma zapirajo svoja vrata. Čeprav so uspešno opravljala svoje delo, nekaterim izmed njih v predvidenem roku trajanja vseeno ni uspelo opraviti vsega, kar jim je bilo zadano. Sčasoma so postala prevelika in stroškovno prevelik zalogaj za količino dela, ki jim je ostala. To je vodilo do oblikovanja in ustanavljanja novih, posebnih institucij, zadolţenih, da kot nasledniki teh sodišč dokončajo njihovo delo. Eno izmed prvih tovrstnih institucij predstavlja Mednarodni rezidualni mehanizem za kazenski sodišči, ki ga splošno sprejeto skrajšano poimenujemo Mehanizem. Leta 2010 je bil kot majhna, začasna in učinkovita institucija ustanovljen, da izvršuje temeljne funkcije Mednarodnih kazenskih sodišč za Jugoslavijo in Ruando. Zasnova, organizacija in delovanje Mehanizma, kljub nekaterim razlikam, namenjenim zagotavljanju Mehanizma kot majhne in učinkovite strukture, izraţajo očiten namen zagotavljanja kontinuitete njegovih dveh predhodnic. Kljub temu, da je Mehanizem produkt natančnega načrtovanja, njegovi snovalci nekaterih zadev niso uredili ali celo niso mogli predvideti. Neurejeno je ostalo vprašanje teţe, ki naj jo Mehanizem pripisuje sodni praksi in precedensom svojih dveh predhodnic, kar je bistvenega pomena za zagotavljanje kontinuitete in ohranjanje njune zapuščine. Mehanizmu je bilo prepuščeno, da se sam opredeli glede vprašanja, kolikšen pomen bi moral oziroma bo pripisoval praksi in precedensom teh dveh sodišč. Drugo, tisto nepredvidljivo zadevo pa je predstavljala aretacija sodnika Akaya, ki je kot sodnik Mehanizma uţival diplomatsko imuniteto, kar je močno vplivalo na Mehanizem in mednarodno kazensko sodstvo.

After a period known for the establishment of many different ad hoc international criminal courts and tribunals, we are now witnessing a new era in which these courts are gradually closing their doors. Although they have done their job successfully, some of them have not been able to do everything they were supposed to do within the prescribed timeframe. Over time, they became too big and too expensive for the amount of work they had left. This led to formation and establishment of new, special institutions in charge of completing their work as successors to these courts. One of the first such institutions is the International Residual Mechanism for Criminal Courts, commonly known as the Mechanism. It was established in 2010, as a small, temporary and efficient institution to perform the core functions of the International Criminal Tribunals for Yugoslavia and Rwanda. The design, organization and operation of the Mechanism, despite some differences, aimed at ensuring that the Mechanism is a small and efficient structure, express the obvious purpose of ensuring the continuity of its two predecessors. Despite the fact that the Mechanism is the product of careful planning and deliberation of various scenarios, its creators did not regulate some issues, or could not even predict them. The issue of the weight to be given to the jurisprudence and the precedents of its two predecessors, which is essential to ensure the continuity and preservation of their legacy, remained unresolved. It was left to the Mechanism to decide for itself on the question of how much importance it should or will attach to the jurisprudence and precedents of these two courts. Another, the unpredictable matter was the arrest of Judge Akay, who enjoyed diplomatic immunity as a judge of the Mechanism, which significantly affected the Mechanism and the international criminal justice. |
