Abstract

V pričujočem delu raziskujemo povezavo med državo BiH danes, Daytonskim mirovnim sporazumom, mednarodno skupnostjo in človekovimi pravicami, kot je bila vzpostavljena z Daytonskim mirovnim sporazumom. Z njim je nadzor in pristojnost nad delovanjem države prešel na mednarodno skupnost, kar je lahko v nasprotju s konceptom suverene države. Sistem v BiH je eden od najbolj kompleksnih sistemov v svetu, kar se kaže tudi na področju človekovih pravic. Delo odkriva temelje med sporazumom in sistemskimi kršitvami pravic, kjer neki napredki zaradi blokad s strani političnih vodij in nacionalnega interesa skupaj s samo Ustavo BiH v veliki meri le tega onemogočajo. Opravljenih je bilo 10 intervjujev, kjer so bili intervjuvani raznoliki sogovorniki, poleg tega so bila kot sekundarna gradiva uporabljena zakonodaja, poročila, članki. Namen pričujočega dela je opisati in analizirati vlogo, odnos in ravnanja ter učinkovitost mednarodne skupnosti v povojni Bosni na področju varovanja človekovih pravic, pri čemer je osredotočenost magistrskega dela na oblike in razsežnosti kršitev človekovih pravic na raznolikih področjih. Pričujoče delo se osredotoča na mednarodne organizacije, ki imajo danes pomembnejšo vlogo pri delovanju države in zaobjame različna področja človekovih pravic. Raziskovalo se je tudi zakaj in kako prihaja do kršitev človekovih pravic ter o tem, kakšna je vloga oziroma ravnanje in odnos mednarodne skupnosti pri temu danes. Sklepamo lahko, da je tema precej neraziskana in bi to magistrsko delo lahko delno zapolnilo del manjkajoče vrzeli in tako pripomogla k temu, da postanemo bolj pozorni na same kršitve ter da se izboljšajo strategije uveljavljanja in zaščite človekovih pravic.

Secondary abstract: In this paper, we explore the connection between the state of BiH today, the Dayton Peace Agreement, the international community and human rights as established by the Dayton Peace Agreement, it transferred control and jurisdiction over the functioning of the state to the international community, which may be contrary to the concept of a sovereign state. The system in BiH is one of the most complex systems in the world, which is also reflected in the field of human rights. The work reveals the foundations between the agreement and systemic violations of rights, where some progress due to blockades by political leaders and the national interest, together with the BiH Constitution itself, largely prevents this. We have conducted 10 interviews, where we had interviewed various interlocutors, in addition, we used legislation, reports, articles as secondary materials. The purpose of this paper is to describe and analyze the role, attitude and actions and effectiveness of the international community in post-war Bosnia in the field of human rights protection, with a focus on the forms and extent of human rights violations in various fields. This work focuses on international organizations, which today play a more important role in the functioning of the country, and covers various areas of human rights. We also researched why and how human rights violations occur and what is the role or conduct and attitude of the international community in this today. We can conclude that the topic is rather unexplored and this master's thesis could partially fill part of the missing gap and thus help us to become more aware of the violations themselves and to improve human rights enforcement and protection strategies.
