Abstract
Diplomsko delo podrobno opredli institut posvojitve, ki ga urejajo tako nacionalni kot tudi mednarodni pravni akti. Posvojitev je oblika socialnega starševstva, pri kateri si starši in otroci ne delijo skupne genske zasnove, kar pomeni, da si niso v sorodu. Institut posvojitve ni nekaj novega. Na osnovi poznanih zgodovinskih dejstev so ga uporabljali že v Mezopotamiji, in sicer v Hamurabijevem zakoniku, in tudi Rimljani v antičnem Rimu, kjer institut posvojitve omenja Justinijanov kodeks. Slovenska zakonodaja posvojitev ureja posredno že z Ustavo Republike Slovenije. Ustavne določbe udejanja ureja Družinski zakonik; ta določa zakonske pogoje postopka za ugotavljanje pogojev za posvojitev, v okviru katerega delavci in delavke ugotavljajo, ali adoptiranci izpolnjujejo vse zakonske pogoje in ali so prijavitelji primerni kot kandidati za posvojitev, postopek odločanja o posvojitvi in primere, v katerih je ta neveljavna in kot taka tudi izpodbojna. Pravo pozna različne oblike posvojitve: popolno, nepopolno, enostransko, posvojitev s strani ene osebe, meddržavno oziroma mednarodno, blanko in inkognito posvojitev. V Republiki Sloveniji blanko in inkognito posvojitvi nista dovoljeni. Posvojitve v Republiki Sloveniji ni mogoče razvezati, vendar jo je mogoče v zakonsko določenih primerih razveljaviti. Diplomsko delo poleg teoretičnega dela o posvojitvi in njeni razveljavitvi vsebuje tudi intervju. Izveden je bil za namene diplomskega dela z osebo, ki je skupaj z možem (zakoncem) v Republiki Sloveniji posvojila deklici

The diploma thesis defines in detail the institute of adoption, which is regulated by both national and international legal acts. Adoption is a form of social parenting in which parents and children do not share a common genetic make-up - they are not related. The institute of adoption is not something new. Based on known historical facts, it was already used in Mesopotamia, namely the Code of Hammurabi and also by the Romans in Ancient Rome, where the institute of adoption mentions Justinian's Code. In Slovenia, adoption is regulated indirectly with the Constitution of the Republic of Slovenia. The constitutional provisions are directly implemented and regulated in more detail by the Family Code. It sets out the legal conditions of the adoption procedure, in which employees determine whether the adoptees meet all the legal requirements and whether the applicants are suitable as candidates for adoption, the adoption decisionmaking process and the cases in which it is invalid and as such rebuttable. The law recognizes various forms of complete, incomplete, unilateral adoption, adoption by one person, interstate or international, blank and incognito adoption. Blank and incognito adoption is not allowed in the Republic of Slovenia. Adoption cannot be dissolved in the Republic of Slovenia, but it can be annulled in cases determined by law. In addition to the theoretical part on adoption and its annulment, the diploma thesis also contains an interview. It was carried out for the purposes of a diploma thesis with a person who, together with her husband (spouse), adopted a girl in the Republic of Slovenia |
