Abstract

V diplomskem delu se bomo ukvarjali z vprašanjem položaja mladoletnih otrok ob razpadu ali razvezi zakonske ali zunajzakonske zveze ter njihovimi pravicami, ki jim pripadajo v vseh postopkih, kjer se odloča o ključnih vprašanjih otrok. Starši imajo glavno in enako odgovornost pri varstvu in vzgoji otroka ter pri njegovem razvoju, upravičeni pa so tudi do pomoči države pri izvajanju svoje odgovornosti. O dodelitvi otrok v vzgojo in varstvo, preživljanju otroka in otrokovih stikih odloči sodišče na podlagi presoje o tem, pri katerem od staršev bo otroku zagotovljena večja korist. Če je to med staršema sporno, si sodišče pri odločitvi praviloma pomaga z mnenjem Centra za socialno delo in otrokovim mnenjem. Otrokovo mnenje se upošteva, če ga je sposoben izraziti sam ali preko nekoga, ki mu zaupa. Sodišče lahko v postopku otroku postavi posebnega zastopnika (zagovornika otroka), ki vzpostavi stik z otrokom in nato sodišču sporoča njegovo videnje in otrokove želje. V primeru, da je otrok ogrožen, se med postopkom lahko sprejmejo tudi začasne odredbe. S sprejetjem Družinskega zakonika je na področju družinskega prava prišlo do nekaterih sprememb na obravnavanem področju postopka za odločanje o varstvu in vzgoji otroka, preživljanju otroka in otrokovih stikih, ki jih bomo prikazali v okviru diplomskega dela

Secondary abstract: In this diploma paper we will deal with the situation of minor children in the event of the dissolution or divorce of a marriage or a civil partnership, and the rights to which they are entitled in all proceedings in which children's key issues are decided. Parents have the primary and equal responsibility for the care and upbringing of their children and for their development, and that the State assists them in the exercise of their responsibility. The court decides on the allocation of custody, maintenance and access to the child on the basis of an assessment of which parent will be more likely to benefit the child. If this is disputed between the parents, the court will normally take the opinion of the Social Work Centre and the child's opinion as a basis for its decision. The child's opinion is taken into account if he or she is able to express it on his or her own or through someone he or she trusts. The court may appoint a special representative (child advocate) for the child in the proceedings, who contacts the child and then communicates the child's views and wishes to the court. Interim orders may also be made during the proceedings if the child is at risk. With the adoption of the Family Code, there have been some changes in the field of family law in the area of child custody, child support and child contact procedures, which will be illustrated in the context of the thesis
