Abstract

Secondary abstract: Foster care belongs to the field of family law. In 2017 a new Family Code was adopted, which replaced or substituted the Marriage and Family Relations Act, and came into force in 2019. Foster care is a special form of education and care for children who, for various reasons, are unable to stay with their family. The key purpose of foster care is to ensure that children, placed with persons other than their parents, take part of upbringing, education, healthy growth, harmonious personal development and training for independent living and work. The court decides on the placement of the child in foster care and on the appointment of a foster parent, and the social work centre concludes then a foster care contract with the foster parent, which defines the foster care relationship with the rights and obligations of the contracting parties. The thesis deals mainly with the field of assessment and regulation of foster care fees, and foster care, as a profession. I wondered whether abuses are permissible. Using the method of description, I came to the conclusion, that the new Family Code regulated this area differently, as according to the Marriage and Family Relations Act, the placement of a child was decided by the centre for social work, whereas now it is decided by the court. For this reason, I believe that foster care is more regulated and systemically regulated, and thus there is significantly less potential for possible abuse.
