Abstract

V času epidemije je zaradi različnih ukrepov za obvladovanje širjenja nalezljive bolezni najbolj prizadeta dolžnost hitrega ukrepanja v postopkih, ki zadevajo otroka. Množično se pojavljajo težave z izvajanjem stikov staršev z otroki, ki so določeni v pravnomočni sodni odločbi, ko starši na primer preprečujejo sodno določene stike, tudi z bojaznijo ali izgovorom prenosa okužbe nevarnosti okužbe otroka. Kadar se stiki po sodni poravnavi ali sodbi ne izvajajo, kot je dogovorjeno oziroma določeno, je možno vložiti predlog za izdajo začasne odredbe. Začasne odredbe za varstvo koristi otrok se pod pogoji, ki jih določa družinski zakonik, izdajo po postopku, ki ga določa zakon, ki ureja zavarovanje. Zakon o nepravdnem postopku (ZNP-1) določa tudi, da so postopki za odločanje o ukrepih za varstvo koristi otrok nujni. Na Ministrstvu za pravosodje pri izvrševanju pravnomočnih sodnih odločb, ki urejajo stike otroka s tistim od staršev, ki mu otrok ni dodeljen v varstvo in vzgojo, apelirajo na starše, da so v svojih postopanjih razumni in odgovorni, da ne ogrožajo koristi svojih otrok iz takšnih in drugačnih razlogov. Če ni mogoče zagotavljati oziroma izvajati stikov zaradi nevarnosti širjenja koronavirusa, predlagajo, da za zagotovitev stika, ki je namenjen ohranjanju odnosa z drugim staršem, uporabljajo tehnologijo. Vrhovno sodišče je poudarilo, da je pri odločanju o stikih v teh težkih časih treba pretehtati, kaj je otroku najbolj v korist. Secondary abstract: At the time of the epidemic, the duty to act swiftly in proceedings affecting a child is most affected by the various measures taken to control the spread of an infectious disease. There are massive problems with the parent-child contact, which are determined in a final court decision, when parents, for example, prevent courtdetermined contacts, also with the fear or excuse of transmitting the infection, the risk of infection of the child. When contacts after a court settlement or judgment are not carried out as agreed or determined, it is possible to file a proposal for the issuance of an interim injunction. Interim injunctions for the protection of the interests of children shall be issued in accordance with the procedure laid down in the law governing insurance, under the conditions laid down in the Family Code. The NonContentious Civil Procedure Act (ZNP-1) also stipulates that procedures for deciding on measures to protect the interests of children are necessary. At the Ministry of Justice, in enforcing final court decisions governing the child's contact with the parent to whom the child is not assigned custody, they appeal to the parents to be reasonable and responsible in their actions, not to jeopardize the interests of their children from such and for other reasons. If it is not possible to provide or make contacts due to the risk of coronavirus spreading, they suggest that technologies be used to ensure contact that is intended to maintain the relationship with the other parent. The Supreme Court stressed that when deciding on contacts in these difficult times, one should consider what is most beneficial to the child. The key is the readiness to adapt and understand the situation and to benefit from the best interests of the child.
