Abstract
S pojavom epidemije SARS-CoV-2 so bile države širom sveta primorane sprejemati različne politike oz. ukrepe, da bi zajezile širjenje virusa in družbi ponovno omogočile normalno življenje. Ukrepi, ki so bili sprva sprejeti, so bili večinoma zgolj napotki posamezniku za zaščito pred virusom: uporaba maske, razkužila in vzdrževanje primerne medosebne razdalje. S porastom števila okužb in hospitalizacij pa so se začela večja zapiranja držav in tudi uvedba policijske ure. Mednarodne organizacije so pri tem poudarile, da morajo države pri odrejanju ukrepov doseči ravnovesje med varovanjem zdravja in spoštovanjem temeljnih človekovih pravic. Sprejeti ukrepi morajo biti v skladu z načelom zakonitosti in sorazmernosti ter ne smejo biti diskriminatorni. Namen magistrskega dela je bil preučiti ukrepe, ki so bili sprejeti v Sloveniji v času epidemije SARS-CoV-2. Ugotavljalo se je, ali so bili ukrepi ob razglasitvi epidemije SARS-CoV-2 sorazmerni s takratnim stanjem v državi in ali so bili v celoti pripravljeni v skladu s pravili pravnega reda. Predstavljeni so pravni izzivi oz. elementi, ki jih mora izpolnjevati ukrep, in bistveni členi Zakona o nalezljivih boleznih. Večji del magistrskega dela predstavljajo ukrepi, sprejeti v prvem in drugem valu, osredotoča pa se predvsem na naslednje tri ukrepe: omejitev gibanja na občine, policijska ura in nošnja mask. V tem delu so predstavljene presoje Ustavnega sodišča Republike Slovenije in mnenja sodnikov oz. pravnikov, podani pa so tudi ostali primeri sodne prakse v povezavi s kršitvijo ukrepov.

With the outbreak of the SARS-CoV-2 epidemic, countries around the world have been forced to adopt different policies or measures to curb the spread of the virus and enable society to return to normal life. The measures tha were initially taken were mostly only instructions to the individual against protection i.e. the use of a mask, disinfectant and the maintenance of a suitable interpersonal distance. With the increase in the number of infections and hospitalizations, however, major state closures began, as well as the introduction of surfews. Interenational organizations have emphasized the need for countries to strike a balance between healt protection and respect for fundamental human rights when ordering measures. The taken measures must comply with the principles of legality and proportionality and must not be discriminatory. The purpose of the master's thesis was to examine the measures taken in Slovenia during the SARS-CoV-2 epidemic. We were interested in whether the measures at the time of the declaration of the SARS-CoV-2 epidemic were proportionate to the situation in the country at the time and whether they were fully prepared by the rules of the legal order. We presented the legal challenges or elements that the measure must meet and the essential articles of the Communicable Diseases Act. The major part of the thesis represent the measures take in the first and second wave and we focused mainly on the following three measures: restriction of movement to municipalities, curfew and mask wearing. This part presents the asessments of the Constitutional Court and the opinions of judges or lawyers, as well as the other examšles of case law in connection with the violation of measures. |
