Abstract

Pravica do določitve lastnega izvora se je v zadnjih nekaj desetletjih izoblikovala v povezavi s pravico do osebne identitete in osebnega razvoja posameznika. V mednarodnem pravu se je pravica do osebne identitete kot samostojna otrokova pravica uveljavila v 8. členu Konvencije o otrokovih pravicah, v evropskem pravnem prostoru pa jo je na podlagi 8. člena Evropske konvencije o človekovih pravicah s sodno prakso izoblikovalo Evropsko sodišče za človekove pravice. Pravica do poznavanja lastnega izvora vključuje dostop do informacij o pomembnih vidikih posameznikovega življenja, zlasti o okoliščinah njegovega rojstva, otroštva in starševskih razmerjih. V zadnjem času se o pravici do določitve lastnega izvora vse pogosteje razpravlja v zvezi s pravico do anonimnosti darovalcev spolnih celic. Obe nasprotujoči si pravici sta zajamčeni v 8. členu Evropske konvencije o človekovih pravicah. Vse glasnejše so zahteve, da se načelo anonimnosti darovalcev spolnih celic umakne v korist otrokovi pravici do določitve lastnega izvora.

Secondary abstract: The right to know one's origins has developed in the last few decades in connection with the right to personal identity and personal development of an individual. In international law, the right to personal identity as an independent child's right has been established in Article 8 of the Convention on the Rights of the Child, whereas in European judicial area it has been established by the European Court of Human Rights by means of its case-law in accordance with Article 8 of the European Convention on Human Rights. The right to know one's origins includes access to information on important aspects of an individual's life, in particular the circumstances of his or her birth, childhood and parental relationships. Recently, the right to determine one's origins has been increasingly discussed in relation to the right to anonymity of gamete donors. Both conflicting rights are guaranteed in Article 8 of the European Convention on Human Rights. There are growing demands that the principle of anonymity of gamete donors should be withdrawn in favour of the child's right to determine his or her own origins.
