Abstract

Kriminaliteta na področju drog je problematika, s katero se moramo ukvarjati tako na nacionalni ravni kot na ravni EU, saj droge vplivajo na vsa področja našega življenja. Magistrsko delo opredeljuje problematiko prepovedanih drog na območju EU in prilagajanje držav trgu s prepovedanimi drogami. V magistrskem delu smo preučili pojme, kot so varnost, nacionalna varnost, organiziran kriminal in prepovedane droge. V nadaljevanju smo opredelili vlogo organov pregona v boju zoper droge in spoznali problematiko, ki jih pri tem ovira. Organi pregona, ki se bojujejo z nezakonito trgovino s prepovedanimi drogami, se srečujejo z vse večjo iznajdljivostjo storilcev kaznivih dejanj, saj ti za storitev tovrstnih dejanj uporabljajo informacijsko tehnologijo, katera jim omogoča mednarodne povezave, ki so težko izsledljive. Organe pregone pri njihovem delu ovira tudi zakonodaja, ki dopušča zelo malo manevrskega prostora pri odkrivanju storilcev kaznivih dejanj trgovine s prepovedanimi drogami. V študiji primerov dekriminalizacije konoplje v Španiji, na Portugalskem in Nizozemskem je bilo ugotovljeno, da bi bil za Republiko Slovenijo najprimernejši model Španije, ki omogoča gojenje in uživanje konoplje v zasebnih prostorih. Pri tem bi morali vzpostaviti učinkovit sistem nadzora nad trgovino s konopljo na nezakonitem trgu. Preučili smo kanadski model legalizacije konoplje, ki je prinesel pozitivne učinke na gospodarstvo in proračun, vendar zaradi še kratkega obdobja legalizacije ni vidnega učinka na javno zdravje in vpliva na nezakoniti trg konoplje.

Secondary abstract: Drug crime is an issue that must be dealt with both on national as well as EU level, since drugs affect all spheres of life. The Master’s thesis defines the issue of illicit drugs on the EU territory and the countries’ adjustments to the illicit drugs market. The Master’s thesis examines notions, such as security, national security, organised crime and illicit drugs. In the continuation, the role of law enforcement in the fight against drugs is defined and the issues hindering it are explained. Law enforcement, which fights illegal drug trafficking, encounters increasing resourcefulness of offenders, since they use information technology to commit such actions, which allows them international connections that are hard to trace. Law enforcement is also obstructed in its work by legislation, since the latter gives it very little leeway to identify offenders involved in drug trafficking. In a case study dealing with the decriminalisation of cannabis in Spain, Portugal and the Netherlands, it was found that the Spanish model, which permits the cultivation and consumption of cannabis in private premises, would be best suited for the Republic of Slovenia. This would require an effective system of control over illegal trafficking of cannabis. We have also examined the Canadian model of cannabis legalisation, which has brought about positive effects on the economy and budget, although the effect on public health and illegal cannabis market has yet to be seen due to the brief period of legalisation.
