Abstract
Človekovo dostojanstvo ni odvisno od posameznikove psihofizične opredelitve, temveč mu pripada iz samega dejstva, da je človek. Zaradi svoje telesne in duševne prizadetosti invalidi uživajo posebno varstvo kot eno temeljnih pravic socialne varnosti. Dejstvo je, da so določene dobrine ugodnosti in tudi pravice, ki so sicer formalnopravno enako priznane vsem, invalidom pa so težje dostopne. Pozitivna dolžnost države je zagotovitev enakih dejanskih možnosti in enakega obravnavanja invalidov, da odpravi, premosti ali zmanjša ovire za neodvisno življenje njih ter njihovo enakopravno vključitev v družbo in delovni proces. Temeljni namen pričujočega magistrskega dela je obravnava pravic invalidov in zaposlovanje invalidov ter problematika uresničevanja le-teh v praksi. Vse to pa je predstavljeno v različnih zakonih. Pri uresničevanju pravic invalidov imajo pomembno vlogo delodajalci, saj je njihova glavna dolžnost in obveznost skrb za njihove pravice in interese, kot jim nalaga Ustava. Zaradi postopne uveljavitve zakonodaje se v Sloveniji ureja le tisti del problematike, ki jih družbe v določenih obdobjih različno zaznajo in razumejo. Skozi prakso novega sistemskega modela poklicne in zaposlitvene rehabilitacije v procesu vračanja na delo je cilj ugotoviti vzroke in predlagati rešitve za neizkazano zanimanje vključitve v poklicno rehabilitacijo, pa čeprav ji zakonodaja pripisuje temeljno pravico. Nemčija, Nizozemska in Švedska različno urejajo pravico do poklicne rehabilitacije. Razlike so vidne pri ponovni vključitvi v delovni proces, ki se različno obravnavajo glede na njihov notranji pravni red posamezne države članice Evropske unije. Za zagotovitev celostne obravnave pravic invalidov in posledično uresničevanje le-teh v praksi sta ključna sodelovanje in večja ozaveščenost širše javnosti.

A person’s dignity does not depend on their physical and mental well-being. They are entitled to it simply due to the fact of being human. Due to their physical and mental impairment, disabled persons have special protection in place as one of the fundamental rights of social security. It is a fact that some of the benefits and rights that are formally and legally recognised to all are not easily accessible to disabled persons. The positive obligation of the state is to ensure equal actual opportunities and equal treatment of disabled persons, to eliminate, bridge or reduce the barriers for their independent life and their equal integration into society and the working process. The main purpose of the Master’s thesis is to discuss the rights of disabled persons and their employment, as well as the issue regarding the exercise of their rights in practice. All of the above is included in various laws. Employers play an important role in the realisation of the rights of the disabled persons, because the main obligation and liability of employers is to take care for their rights and interests as imposed on them by the Constitution. Only a part of a policy issue that is detected through society in certain periods of time is a topic of societal debate, due to the gradual implementation of legislation. Through the practice of the new systematic model of occupational and vocational rehabilitation in the return to work process, the aim is to ascertain the reasons and propose solutions for the lack of interest for their inclusion to occupational rehabilitation, even though this fundamental right is governed by law. Germany, the Netherlands and Sweden have various interpretations of the right to occupational rehabilitation. Differences are observed in the re-integration into the working process, which are discussed differently based on the internal legal order of each EU Member State. To ensure a comprehensive discussion of the rights of disabled persons and their realisation in practice, cooperation and an increased awareness of the general public is key. Only a part of a policy issue that is detected through society in certain periods of time is a topic of societal debate, due to the gradual implementation of legislation. |
