Abstract

Magistrsko delo obravnava postopek volitev ustavnih sodnikov Republike Slovenije, pri čemer je poudarek predvsem na prikazu in analizi samega postopka ter ugotavljanju morebitnega vpliva politične usmerjenosti kandidatov na samo imenovanje ter kasnejše volitve. Primerjalno so v delu obravnavani tudi postopki volitev ustavnih sodnikov v nekaterih drugih državah Evropske unije, zlasti v Avstriji, Italiji ter na Hrvaškem, na podlagi katerih lahko ugotovimo, kakšen sistem imenovanja oziroma volitev trenutno prevladuje v Evropi. Magistrsko delo se osredotoča tudi na pomen razmerja in soodvisnosti prava in politike, kar lahko posledično vodi v vprašanje (ne)političnosti ustavnega sodišča. Zastavljene hipoteze so lahko ali potrjene ali zavrnjene, ter obrazložene na podlagi sintetične in aksiološke metode, v katerih je na podlagi združenja bistvenih ugotovitev ter osebnega ovrednotenja in ocenjevanja razvidno kritično osebno stališče, ki je hkrati tudi končni rezultat raziskave. Namen raziskave je prikazati, analizirati in opredeliti sam postopek volitev ustavnih sodnikov ter ugotoviti, kateri dejavniki igrajo v tem postopku bistveno vlogo, v čem je njihova prednost in slabost in predvsem, kdo je zanje odgovoren. Cilj raziskave je dokazati, da je v postopku imenovanja in volitev ustavnih sodnikov v Sloveniji in drugod po Evropi poleg vseh pravnih pogojev, bistvenega pomena politična usmerjenost kandidata. Pričakujem, da bo obravnavana tematika pripomogla k boljšemu razumevanju poteka samega postopka volitev ustavnih sodnikov in utrjevanju postopka volitev v praksi.

Secondary abstract: The master's thesis deals with the procedure of electing constitutional judges of the Republic of Slovenia. The emphasis is on presenting and analyzing the procedure itself and determining the possible influence of the political orientation of candidates on the appointment and subsequent elections. Comparatively, the paper also deals with procedures for the election of constitutional judges in some other countries of European Union, especially in Austria, Italy and Croatia, on the basis of which we can determine what system of appointment or election is currently prevalent in Europe. Furthermore, the master's thesis also focuses on the importance of the relationship and interdependence of law and politics, which may consequently lead to the question of the (non) political nature of the Constitutional Court. Based on the combination of essential findings and personal evaluation and assessment, a critical personal point of view is evident, which is also the final result of the research. The purpose of this research is to show, analyze and define the process of electing constitutional judges and to determine which factors are most important in this process, what are their advantages and disadvantages and, above all, who is responsible for them. The aim of the research is to prove that in the process of appointing and electing constitutional judges in Slovenia and elsewhere in Europe, the political orientation of candidate is essential. I expect that the research or the topic will contribute to a better understanding of the procedure of the election of constitutional judges process and the consolidation of the election process in practice.
