Abstract
Človekove pravice so predvsem v razvitem delu sveta postale samoumevne in zdelo se je, da nam jih nihče ne more vzeti. Vendar se je vse spremenilo, ko je Svetovna zdravstvena organizacija razglasila pandemijo. V Sloveniji sta bila sprejeta Odlok o začasni prepovedi gibanja in zbiranja ljudi na javnih mestih in površinah v Republiki Sloveniji ter prepoved gibanja zunaj občin, ob katerem smo se šele začeli zavedati, kako zastrašujoč pomen ima beseda omejitev. Omejitev gibanja in zbiranja sicer ni neposredno povezana s pravico do svobode združevanja, a jo močno zaznamuje. Z magistrskim delom želimo dokazati, da zakonska ureditev pravice v skladu z mednarodnimi standardi prinaša njeno učinkovito uresničevanje v praksi. Prav s proučevanjem te pravice lahko spoznamo stanje demokracije v zadevni državi. Ugledne evropske institucije, ki delujejo že več desetletij ter so v vseh letih pridobile veliko znanja in strokovnosti, so pripravile teoretična izhodišča o pravici do svobode združevanja, ki jo Evropsko sodišče za človekove pravice razvija in pojasnjuje skozi sodno prakso. Sodišče vedno poudarja, da mora biti omejitev te pravice upravičena in sorazmerna s ciljem, ki ga želi doseči, saj neupravičene omejitve človekovih pravic zapuščajo posledice tako v družbi kot pri posameznikih. Zaradi omejitev, ki jih doživljamo v času pandemije, si danes lahko predstavljamo, kako bi bilo živeti brez uživanja človekovih pravic, in močno upamo, da nismo ponovno na začetku poti.

We are taking human rights for granted we thought that no one can take them away from us. But everything changed when the World Health Organisation declared a pandemic. In our country the Ordinance on the temporary prohibition of public gathering at public meetings and public events and other events in public places and the prohibition of movement outside the boundaries of municipalities has been issued. The limitation of movement and gathering are not directly connected to the right to associate, but they are strongly marked by it. With master's thesis we want to prove that the legal regulation of a right in accordance with international standards brings the effective exercise of this right in practice. It is through the study of this right that we can recognize the state of democracy in a certain country. Reputable European institutions have prepared theoretical starting points on the right to freedom of association, which the European Court of Human Rights develops and explains through case-law. The Court has always emphasized that the restriction of this right must be justified and proportionate to the aim which it seeks to achieve. Unjustified restrictions of human rights have consequences, both in society and for the individual. Because of the limitations that we experienced during the pandemic, we can imagine what it would be like to live deprived of human rights, and hope that we are not at the beginning of a new path. |
