Abstract

Pridobitev državljanstva po izredni naturalizaciji je eden izmed rednih in veljavnih načinov pridobitve slovenskega državljanstva. Gre za pridobitev državljanstva na podlagi prošnje posameznika. Vsaka država suvereno odloča, kakšna merila bo postavila za takšen način pridobitve državljanstva. Glavna razlika v primerjavi z redno naturalizacijo je ta, da mora država imeti korist od prosilca, ter tudi, da gre pri izredni naturalizaciji za lažje pogoje pridobitve državljanstva kot pri redni, saj se ne zahteva dolge dobe prebivanja v državi in še nekaterih ostalih pogojev, ki v veliko primerih posamezniku otežujejo pridobitev državljanstva. Sprejem posameznika v državljanstvo mora koristiti državi iz nacionalnih, znanstvenih, gospodarskih, kulturnih ali podobnih razlogov. Izredna naturalizacija je mogoča za polnoletne osebe, ki s svojo dejavnostjo pripomorejo k mednarodnemu ugledu države. V diplomski nalogi bomo z deskriptivno metodo opisali sam postopek in morebitne posebnosti instituta izredne naturalizacije, koliko je država dolžna upoštevati mednarodna pravila pa tudi, kaj se zgodi s primarnim državljanstvom posameznika. Na koncu pa se bomo osredotočili na tako imenovano »prodajo« državljanstva, ki je dvignila veliko prahu, še posebno na ravni Evropske unije, kar je seveda upravičeno, saj ti posamezniki tako pridobijo tudi državljanstvo Unije in s tem prosto gibanje znotraj le-te

Secondary abstract: Acquisition of citizenship by way of extraordinary naturalization is one of the regular and valid ways of acquiring Slovenian citizenship. It is a matter of acquiring citizenship at the request of an individual. Each country sovereignly decides what criteria it will set for such acquiring citizenship in such a way. The main difference with regular naturalization is that the state must benefit from the applicant. In addition, that extraordinary naturalization has easier conditions for acquiring citizenship than regular, as it does not require a long period of residence in the country or some other conditions that in many cases make it difficult for an individual to acquire citizenship. The admission of an individual to citizenship must benefit the state for national, scientific, economic, cultural or similar reasons. It is possible for adults who contribute to the international reputation of the country through their activities. In my diploma thesis, we will use a descriptive method to describe the procedure itself with any possible peculiarities of the institute of extraordinary naturalization. And to what extent is the state obliged to comply with international rules as well as what happens to an individual’s primary citizenship. Finally, we will focus on the so-called 'sale' of citizenship, which caused a great stir, especially the European Union level. Which is, of course, justified, since these individuals also acquire the citizenship of the Union and thus free movement within it
