Abstract

Prispevek obravnava preobrazbo moderne države v postmoderno. Opozarja na vse tesnejše partnerstvo med državo in civilno družbo, ki poteka bodisi z delegiranjem funkcij državnih organov na organizacije civilne družbe bodisi s kooptiranjem predstavnikov civilne družbe v procese odločanja državnih organov. Analize nekaterih zakonov, ki se nanašajo na regulacijo družbenih dejavnosti, kažejo na to, da povezave med državo in civilno družbo v slovenski zakonodaji potekajo v znamenju manipulativne kooptacije predstavnikov civilne družbe v državne organe in v znamenju paternalističnega delegiranja državnih funkcij na kvaziavtonomne fundacije in agencije. Oboje generira kolonizacijo države nad civilno družbo, kar bo nedvomno občutno zavrlo razvoj slovenske družbe kot celote.

Secondary title: Sociological aspects of transition from modern to postmodern state
Secondary abstract: The article deals with the transformation of modern society to postmodern one. It calls attention to closer partnership between the state and civil society which is carried out either through delegation of functions of state organs to organization of civil society organizations or through co-optation of civil society representatives into the decision-making processes within state organs. Analyses of some legal acts regarding regulation of social activities show that relations between the state and civil society in Slovenian legislation are carried out in the light of manipulative co-optation of civil society representatives and in the light of paternalistic delegation of state functions to the quasi-autonomous foundations and agencies. Both mean colonization of state over civil society. This will undoubtedly brake the development of Slovenian society in general.
