Abstract

POVZETEK Zavarovanje je oblika zavarovalne pogodbe oziroma zavarovalnega pogodbenega razmerja med zavarovalnico in skleniteljem zavarovanja. Iz tega naslova izhajajo pravice in obveznosti obeh pogodbenih partnerjev. Tako kot v gospodarstvu se tudi v zavarovalništvu soočajo s težavami plačilne nediscipline. Velik del odgovornosti za nastalo stanje je mogoče pripisati pomanjkanju znanja, nestrokovnosti kadrov, splošni gospodarski krizi in slabemu delovanju sodstva. Nerešeni spori pomenijo za upnike neporavnane terjatve, ki lahko privedejo do finančnih težav. Verižna reakcija nezmožnosti plačevanja in hkrati še izmikanje plačevanju nekaterih pravnih ter fizičnih oseb pa sta privedla slovensko gospodarstvo do kritičnega praga plačilne nediscipline. Takšno stanje deluje zaviralno ne samo na gospodarstvo, temveč tudi na zavarovalnice. V diplomski nalogi bom opisal in analiziral nekatere postopke reševanja izterjave neplačanih oziroma zamudnih terjatev. Izsledki analize kažejo, da se je število neporavnanih obveznosti v obdobju od 2008 do 2009 povečevalo. Za izboljšanje poslovanja sta potrebna boljši nadzor solventnosti skleniteljev zavarovanja in večja učinkovitost sodišč.

Secondary abstract: ABSTRACT Insurance is a form of insurance contract or insurance contract relationship between the insurer and the policy holder. Thus there are the rights and duties of both contractual partners. The insurance industry as well as the economy is facing difficulties of paying misconduct. A large share of resposibility for the resulting situation can be attributed to a lack of knowledge, incompetence of staff, the general economic crisis and the poor functioning of the judiciary. Unresolved conflicts pose to creditors' outstanding claims, which can lead to financial problems. Chain reaction of inability to pay, while still dodging the payment of certain legal and natural persons in the Slovenian economy have led to a critical threshold of payment indiscipline. This situation has inhibitory effects not only on economics but also on insurance companies. In this thesis I will describe and analyze some of the procedures to solve the recovery of unpaid or late claims. The result of the analysis indicate the increase of outstanding commitments for the period from 2008 to 2009. Factors to improve business are better control of policy holder's solvency and the increased efficiency of courts.
