Abstract

Kriminal v gradbenem sektorju se je izvrševal običajno s strani vodstva družb. Pri tem so bili oškodovani delavci in sama podjetja. V gradbenem sektorju je bilo pred izbruhom finančne krize zaposlenih preko oseminosemdeset tisoč ljudi. Kršitve so se dogajale na področju zaposlovanja, bivalnih pogojev, varnosti in izplačilih plač. Število dovoljenih ur dela so delavci pogosto prekoračili, plač niso redno prejemali, poleg tega niso prejeli pogodbe o zaposlitvi ali pa so bili prisiljeni v takojšen podpis pogodb. Velik problem v gradbeništvu pa predstavlja tudi delo na črno. Vodstvo nekaterih družb je s poslovanjem veliko zaslužilo. Pri tem so s pomočjo dogovorov in usklajevanj prevzeli projekte. V pomoč so jim bili tudi javni razpisi, na katerih se je cena gradnje iz jamstveno najnižje na začetku spremenila v zakonsko dovoljeno, oziroma to tudi prekoračila. Z ustanavljanjem hčerinskih družb pa se je denar prenašal iz družbe na družbo in tako omogočil številne neracionalne transakcije. Organi odkrivanja gospodarskega kriminala oziroma kriminala v gradbeništvu se srečujejo s povečanim deležem odkrite kriminalitete. Tej obliki kriminalitete so v zadnjih letih začeli posvečati vse več pozornosti. Izpopolnjevati pa se je začela tudi zakonodaja, ki bo v prihodnje skušala v boljši meri preprečevat takšne oblike kriminala. V diplomski nalogi so predstavljene kršitve v gradbeništvu, ki so bile storjene do delavcev, podjetij in države.

Secondary abstract: Crime in construction sector was traditionally performed by management. Thus workers and enterprises themself were harmed. Before the financial crisis has erupted, more than eighty eight thousand people were employed in construction sector. Violations were happening on area of employment, living conditions, security and payments of salaries. Workers often exceeded the number of authorized hours of work, their wages were not regularly received, they have not received agreements or they were forced to sign agreements immediately. Major problem in construction sector is also an illegal work. Management of some enterprises made big benefits across economic operations. Agreements and adjustments helped them to overtake projects. Invitations to tenders also helped them, where the cost of construction of the minimum guarantee at the beginning later changed in the law allowed, and it also exceeded. By setting up subsidiaries, the money was passed down from society to society and allowed many irrational transactions. Authorities of the detection of economic crime or crime in the construction industry are faced with an increased proportion of detected crime. This form of crime in recent years started to pay an increasing attention. Legislation is also improving, so it will further seek to better measure to prevent such crimes. The thesis presents violations in construction, which were made up to workers, companies and countries.
